Autoridade de Emissão na Decisão Europeia de Investigação – Parte II

Abstract

O conceito de “autoridade judiciária” e de “autoridade de emissão” tem disputado algumas discussões e interpretações por parte do Tribunal de Justiça da União Europeia em sede da matéria do mandado de detenção europeu. Uma vez transposta a Diretiva 2014/41/UE, do Parlamento Europeu e do Conselho, de 3 de abril de 2014, que deu lugar à Lei n.º 88/2017, de 21 de agosto, e contendo esta, no seu artigo 3.º, na alínea c), o conceito de «autoridade de emissão», pretendemos averiguar se a interpretação daquele Tribunal se estenderia nos mesmos moldes limitativos ao mecanismo da decisão europeia de investigação, por razões atinentes à independência do Ministério Público em relação ao poder executivo. O Acórdão do Tribunal de Justiça da União Europeia, de 8 de dezembro de 2020, no processo C 584/19, veio clarificar a questão. The concepts of “judicial authority” and “issuing authority” have generated some discussions and interpretations by the Court of Justice of the European Union regarding these matters in relation to the European Arrest Warrant. Directive 2014/41/EU, of the European Parliament and of the Council, of April 3, 2014, was transposed through Law nº 88/2017, of August 21, and contains, in its article 3.º, subparagraph c), the concept of "issuing authority". Therefore, we intend to investigate whether the interpretation of that Court would extend in the same limiting terms to the mechanism of the European Investigation Order, for reasons relating to the independence of the Public Prosecutor's Office in relation to executive power. The judgment of the Court of Justice of the European Union, of December 8, 2020, in case C 584/19 clarified the issue.
