Abstract
Apresentamos um estudo que pretende reflectir sobre o disposto no artigo 36.º da Constituição da República Portuguesa de 1976 que proclama o direito de todos de constituir família e de contrair casamento em condições de plena igualdade, regulando a lei os requisitos e os efeitos do casamento e da sua dissolução, por morte ou divórcio, independentemente da forma de celebração. Mais consagra a igualdade dos cônjuges quanto aos respectivos direitos e deveres.
Partimos da polémica gerada nos meios de comunicação social, no ano de 2017, em torno de um Acórdão proferido no Tribunal da Relação do Porto, que aduzia fundamentos, no mínimo discutíveis, em sede de crimes perpetrados contra uma mulher casada, em contexto de adultério.
Com esse mote, foi realizada uma análise documental histórica situada no direito português das codificações relevantes dos séculos XV a XIX no sentido de apurar o tratamento penal então dado à mulher adúltera, apenas com base nos documentos específicos seleccionados: as Ordenações Afonsinas, as Ordenações Manuelinas e as Ordenações Filipinas.
We present a study that intends to reflect on the provisions of article 36 of the Constitution of the Portuguese Republic of 1976 that proclaims the right of all to constitute a family and to enter into marriage in full equality, with the law regulating the requirements and effects of marriage and of its dissolution, by death or divorce, regardless of the form of celebration. It further enshrines the equality of spouses as to their rights and duties. Starting from the controversy generated in the media in 2017, around a Judgment rendered at the Court of Appeal of Oporto that adussed grounds, at least debatable, for crimes committed against a married woman in the context of adultery. With this motto, a historical documentary analysis was carried out in portuguese law of the relevant codifications of the XV-XIX centuries in order to ascertain the criminal treatment then given to the adulterous woman, based only on the specific and selected documents: Afonsinas Ordinances, Manuelinas Ordinances and the Philippine Ordinations.
