Abstract
Em decorrência da necessidade de se estudar as medidas cautelares de
natureza pessoal e o cabimento do poder geral de cautela no processo penal, o
presente estudo - embasado em pesquisa bibliográfica, na legislação específica sobre
o tema, em pesquisas doutrinárias, em leis esparsas, no vigente diploma processual
penal, bem como em entendimentos jurisprudenciais e no direito comparado -
apresentou vários pontos de vista. Arrematou-se que tal poder é plenamente aplicável
no processo penal, sendo, inclusive, fonte de inspiração do legislador, o qual tipifica
as medidas anteriormente aplicadas em sede de poder geral de cautela (diversos
exemplos foram apresentados). Verificou-se, entretanto, uma certa automatização da
prisão preventiva, a qual vinha sendo aplicada sem a devida análise do caso concreto,
destituída dos princípios da adequação e necessidade. Na maioria das vezes, se
constatou que a prisão processual foi mais gravosa que a sentença ao fim do processo,
a qual previa medidas restritivas de direito ou, até mesmo, absolvição. Concluiu-se,
portanto, que tal cenário decorre da exígua utilização das medidas cautelares, o que
tem acarretado um excesso de presos provisórios e, por conseguinte, a falibilidade do
sistema carcerário pátrio. Nesse sentido, apresentou-se como solução o investimento
no recente instituto das audiências de custódia que, entre outras finalidades, aproxima
o magistrado do apreendido, incentivando a adoção de medidas cautelares diversas
da prisão, o que, espera-se, poderá revigorar os presídios brasileiros, propiciando a -
outrora utópica- reinserção social dos egressos.
As a result of the need to study precautionary measures of a personal nature and the applicability of the general power of caution in criminal proceedings, this study, based on bibliographic research, specific legislation on the subject, doctrinal research, scattered laws, the current criminal procedural code, as well as jurisprudential opinions and comparative law, presented several perspectives. It was concluded that such power is fully applicable in criminal proceedings and is even a source of inspiration for the legislator, who typifies measures previously applied under the general power of caution (several examples were provided). However, there was a certain automatization of pretrial detention, which was being applied without the proper analysis of the specific case, lacking the principles of suitability and necessity. In most cases, it was found that pretrial detention was more onerous than the final sentence in the process, which provided for restrictive measures or even acquittal. Therefore, it was concluded that this situation results from the limited use of precautionary measures, leading to an excess of pretrial detainees and, consequently, the failure of the national prison system. In this regard, the solution presented was an investment in the recent institution of custody hearings, which, among other purposes, brings the magistrate closer to the detained individual, encouraging the adoption of alternative precautionary measures to detention. It is hoped that this can rejuvenate Brazilian prisons, fostering the once-utopian social reintegration of former inmates.
