Abstract
Neste trabalho busca-se analisar a influência que o Poder Judiciário, com ênfase aos sistemas brasileiro e português, exercem frente aos demais poderes (órgãos de soberania). Trata-se do fenômeno do ativismo judicial. A pesquisa concentrou-se em alguns julgados exarados pelo Supremo Tribunal Federal e pelo Tribunal Constitucional na última década, especialmente no âmbito do controle de constitucionalidade, em que a temática (da quebra) da separação e harmonia de poderes foi ventilada, seja pelos autores envolvidos, seja pela crítica doutrinária. Para tanto, por meio de pesquisa dedutivo-descritiva, colheu-se bibliografia e jurisprudência específica. A Contextualização centrou-se no levantamento histórico sobre a Teoria da Separação dos Poderes, a partir dos pensamentos de Aristóteles, Jonh Locke e Montesquieu. Na sequência, demonstra-se a estrutura e distribuição de competência entre os poderes no Brasil e órgãos de soberania em Portugal, bem como os aspectos considerados relevantes sobre o controle de constitucionalidade. A sobreposição do Poder Judiciário, em que pese alguns excessos que devem ser combatidos, é tratada como necessidade decorrente da crise de representatividade da classe política e da dissociação do que está previsto nas constituições, como a falha na execução das políticas públicas.
This paper analyzes the influence that the Judiciary Power, with emphasis on the Brazilian and Portuguese systems, exerts over other powers (sovereign bodies). This is the phenomenon of judicial activism. The research focused on case law issued by the Supreme Court and the Constitutional Court in the last decade, especially in the scope of constitutional reviews, in which the theme (the lack) of separation and harmony of powers was discussed, either by the authors involved, or by doctrinal criticism. Therefore, through deductive-descriptive research, specific bibliography and case law were collected. The Contextualization focused on the historical survey on the Theory of Separation of Powers, based on the thoughts of Aristóteles, John Locke and Montesquieu. Next, it is demonstrated the structure and distribution of competence between the powers in Brazil and sovereign bodies in Portugal, as well as the aspects considered relevant to the control of constitutionality. The overlapping of the Judiciary, despite some excesses that must be fought, is treated as a necessity arising from the crisis of representation of the political class and the dissociation from what is provided for in the constitutions, such as the failure to implement public policies.
