Abstract
O contrato de empreitada consagrado em direito português comporta algumas
especificidades que o diferenciam dos outros tipos de prestação de serviços.
Não obstante, existem situações que, pela complexidade prática ou até mesmo
por “linhas divisórias” demasiado ténues, fazem com que esta figura muitas
vezes se confunda com outros tipos contratuais, nomeadamente a prestação
de serviços, o mandato, o depósito, o contrato de trabalho e a compra e
venda.
A noção de obra é, desde logo, um conceito fundamental para que melhor se
consiga definir a distinção entre uns e outros contratos.
E desde logo, para que se consiga definir a noção de obra terá que se ter a
noção clara das várias classificações de coisas existentes e consagradas no
Código Civil.
Ao definir as referidas classificações deparamo-nos com a controvérsia maior
que se encontra intrínseca ao contrato de empreitada e à sua noção. É que
tanto na jurisprudência como na doutrina encontramos opiniões diversas e
opostas: numa delas acredita-se e defende-se que as obras incorpóreas são
parte integrante da noção de obra no contrato de empreitada; já na outra
acredita-se em ideia completamente oposta, levando a que se exclua
determinantemente as coisas corpóreas da referida noção.
The works contract as it is enshrined in the Portuguese legislative scheme contains some peculiarities that differentiate it from other types of services. Nevertheless, there are situations, practice or even by "dividing lines" too tenuous, this complexity figure is often confused with other types of contracts. The notion of work, of course, is a prerequisite for better able to define the distinction between one and the other concept. This definition incorporates several skills, including the various classifications of existing and dedicated things in the Civil Code. By defining these ratings are faced with the biggest controversy that is intrinsic to the construction contract and its notion. It is both in jurisprudence and doctrine found in diverse and opposing views: one of them is believed and argued that intangible works are an integral part of the notion of work for the contract; already in the other believes in complete opposite idea, taking it decisively excludes such corporeal things of that term.
