Abstract
O presente estudo tem como tema a responsabilidade internacional pelo
incumprimento de normas convencionais da Organização Internacional do Trabalho
relativas ao trabalho. A dissertação inicia abordando a relação entre trabalho e direitos
humanos. Para tanto, expõe o trabalho como um direito humano percebido como
internacional; explica o direito internacional do trabalho e os fatores que levaram à
internacionalização das normas de direitos humanos; expõe as reclamações que
correm contra o Brasil e Portugal na Organização Internacional do Trabalho; e
demonstra a importância da Organização Internacional do Trabalho no cenário
internacional nas relações de trabalho, a importância social de seus protocolos e as
convenções da Organização Internacional do Trabalho à luz do conceito atual de
direitos humanos. Na sequência, discute a responsabilidade internacional pela afronta
aos direitos humanos; e, por fim, explica como se dá o controle do comportamento dos
estados-membros da Organização Internacional do Trabalho, apresentando exemplos
e esclarecendo sobre a invocação da responsabilidade internacional. Para tanto,
emprega o método de abordagem dedutivo partindo da legislação e convenções
existentes sobre o tema. Referente ao método de procedimento, optou-se pelo
monográfico, empregando-se as técnicas de pesquisa bibliográfica e documental. A
abordagem dos citados conteúdos permite que se chegue aos reflexos da
responsabilização internacional pelo incumprimento de normas convencionais da
Organização Internacional do Trabalho relativas ao trabalho sobre os Estados que
ratificam as convenções.
The present study has as its theme the international responsibility for the noncompliance with conventional norms of the International Labor Organization related to work. The dissertation begins by addressing the relationship between work and human rights. To this end, it exposes work as a human right perceived as international; explains international labor law and the factors that led to the internationalization of human rights standards; exposes the complaints that are running against Brazil and Portugal in the International Labor Organization; and demonstrates the importance of the International Labor Organization on the international scene in labor relations, the social importance of its protocols and the conventions of the International Labor Organization in the light of the current concept of human rights. In the sequence, it discusses the international responsibility for the affront to human rights; and, finally, it explains how the behavior of the member states of the International Labor Organization is controlled, presenting examples and clarifying the invocation of international responsibility. To do so, it uses the deductive approach method based on existing legislation and conventions on the subject. Regarding the procedure method, we opted for the monograph, using the techniques of bibliographic and documentary research. The approach of the aforementioned contents allows to arrive at the reflections of the international responsibility for the non-compliance with conventional norms of the International Labor Organization regarding the work on the States that ratify the conventions.
