A transição para a democracia em Portugal e sua importância nos direitos fundamentais.

Abstract

Em 25 de Abril de 1974 ocorreu em Portugal uma revolução que teve como propósito pôr fim ao regime político ditatorial até aí vigente, apoiado pela Constituição de 1933 e instaurar um regime político democrático. Consolidada a vitória, em 25 de Abril de 1975 ocorreram, pela primeira vez em Portugal, eleições por sufrágio directo e universal, para eleição de uma Assembleia Constituinte cuja tarefa, atribuída pelos cidadãos eleitores, foi a de criar uma nova Constituição da República Portuguesa, que refletisse os ideais que inspiraram a revolução, nomeadamente, os conceitos de Estado de Direito, de Estado Social garantidor dos direitos fundamentais dos cidadãos, e ancorado num regime político democrático. A nova Constituição entrou em vigor em Abril de 1976. Esta rutura constitucional teve reflexos muito importantes na sociedade portuguesa, permitiu a legalização de partidos políticos, que até aí viviam na clandestinidade, a Assembleia Constituinte eleita refletiu já o pluripartidarismo ideológico que a nova Constituição veio consagrar bem como o pluralismo institucional, o catálogo de direitos fundamentais foi alargado aos direitos sociais em sentido amplo, e é esta interligação entre a transição constitucional e a proteção dos direitos fundamentais que nos propomos aflorar. On April 25, 1974 took place in Portugal a revolution that aimed to put an end to the dictatorial political regime by force there, supported by the 1933 Constitution and establish a democratic political regime. Consolidated victory on April 25, 1975 took place for the first time in Portugal, elections by direct suffrage and universal, for the election of a Constituent Assembly whose task assigned by voters, was to create a new Constitution of the Portuguese Republic, that reflected the ideals that inspired the revolution, namely, the rule of law concepts of welfare state guarantor of fundamental rights of citizens, and anchored in a democratic political regime. The new Constitution came into force in April 1976.
