Abstract
O presente estudo objetiva discutir a seletividade estatal e o direito penal do inimigo à luz da doutrina criminal moderna. Para tanto, inicia apresentando reflexões sobre a pena, sua finalidade e panorama atual do sistema prisional brasileiro; explica a teoria do Direito Penal do Inimigo apontando sua origem e filosofia; e aborda a instrumentalização da teoria da co-culpabilidade do Estado como forma de mitigar o direito penal do inimigo. Para o desenvolvimento desta pesquisa, como metodologia, foi empregada a revisão bibliográfica da doutrina e recorreu-se à legislação pertinente. Concluiu-se que são muitas as vítimas produzidas por um Direito Penal seletivo e direcionado ao inimigo fazendo-se necessária a mudança de mentalidade e que sejam firmadas parcerias entre os ministérios, a exemplo dos responsáveis pela educação, emprego, habitação, meio ambiente, recreação, saúde e serviços sociais, assim como a polícia e a justiça, com vistas a obter redução nos índices de criminalidade, a partir do estabelecimento de estratégias de dinâmica proativa em detrimento das estratégias reativas, de forma a obstar o crime e a vitimização.
The present study aims to discuss the enemy's state selectivity and criminal law in the light of modern criminal doctrine. To this end, it starts by presenting reflections on the penalty, its purpose and current panorama of the Brazilian prison system; explains the Enemy's Criminal Law theory by pointing out its origin and philosophy; and addresses the instrumentalization of the State's co-culpability theory as a way of mitigating the enemy's criminal law. For the development of this research, as a methodology, a bibliographic review of the doctrine was used and the relevant legislation was used. It was concluded that there are many victims produced by a selective Criminal Law and directed at the enemy, making it necessary to change the mentality and that partnerships be established between the ministries, such as those responsible for education, employment, housing, environment, recreation. , health and social services, as well as the police and justice, with a view to achieving a reduction in crime rates, based on the establishment of proactive dynamics strategies to the detriment of reactive strategies, in order to prevent crime and victimization.
