Abstract
A consolidação dos meios de resolução extrajudicial de conflitos (RAL), a sua afirma- ção no sistema de justiça e o reconhecimento da sua eficácia e eficiência constituem objetivos atuais do Estado na administração da justiça e na promoção do acesso a meios de resolução de conflitos. Em Portugal, o Estado criou uma nova arquite- tura da administração da justiça, através de um sistema jurídico multifacetado e heterogéneo que conjuga mecanismos judiciais e extrajudiciais. Neste contexto, é importante perceber a relevância socioeconómica dos RAL e analisar a forma como os cidadãos os avaliam. Porquanto, o melhor conhecimento da perceção do cidadão proporcionará o aperfeiçoamento do modelo e o melhor desempenho das instituições e dos seus intervenientes. Tendo em consideração os estudos empíricos e teóricos sobre o funcionamento da justiça, este artigo visa mostrar os resulta- dos obtidos, de modo a procurar conhecer o posicionamento do cidadão face à Justiça. Visto que os meios RAL são atualmente uma peça fundamental na cons- trução de um sistema de justiça que se mostre completo, adequado e eficiente, a análise e as recomendações apresentadas no presente estudo poderão constituir parte da base necessária para melhorar e sustentar a promulgação de políticas públicas no âmbito da administração da justiça.
The strengthening of alternative dispute resolution (ADR), their implementation in the justice system and the recognition of their effectiveness and efficiency must be government goals in the administration of justice and in the promotion of the access to dispute resolution mechanisms. In the Portuguese legal system, the State has created a new architecture, through a multifaceted and heterogeneous legal sys- tem, combining judicial and extrajudicial means. In this context, it is important to understand the socio-economic relevance of ADR and to analyse how citizens eval- uate them. A better knowledge of the citizen’s perception will improve the model and the performance of the institutions and their agents. By considering the existing empirical studies, complemented with theoretical studies on the functioning of jus- tice, this paper aims to show the results obtained, in order to understand the citi- zen’s position in relation to Justice. Considering that ADR are currently a fundamen- tal piece in the construction of a justice system that aims to be completed, adequate, fast, effective and efficient, the analysis and recommendations adopted may be part of the necessary basis to improve and sustain the judicial architecture and the administration of justice.
