Abstract
Esta dissertação trata de analisar a formação do comportamento delitivo. Ressalta-se o objetivo geral em compreender a teoria da associação diferencial e os objetivos específicos, a saber: descrever o contexto que envolveu a criação da teoria em questão; analisar os pressupostos que influenciaram Sutherland; apresentar a teoria e o autor da associação diferencial; conceituar os crimes de colarinho branco; e identificar no ordenamento jurídico brasileiro sua categorização. Realiza-se uma investigação teórica/epistemológica e interdisciplinar, conjugando uma análise histórica da Sociologia Criminal focalizada nos fatores socioambientais da criminalidade. Segundo a abordagem de Sutherland, considera-se que existe uma dialética na formação do comportamento delituoso. Mais especificamente, verifica-se que o processo dialético perpassa por interação e isolamento dos indivíduos, condições contextuais favoráveis ao delito, um processo de comunicação, direção de motivos, impulsos e racionalização de atitudes, com frequência, duração, interesse e intensidade.
This dissertation tries to analyze the formation of criminal behavior. The general objective of understanding the theory of differential association and the specific objectives is emphasized, namely: to describe the context that involved the creation of the theory in question; analyze the assumptions that influenced Sutherland; present the theory and the author of the differential association; conceptualize white collar crimes; and to identify its categorization in the Brazilian legal system. A theoretical / epistemological and interdisciplinary investigation is carried out, combining a historical analysis of Criminal Sociology focused on the socioenvironmental factors of criminality. According to Sutherland's approach, it is considered that there is a dialectic in the formation of criminal behavior. More specifically, it appears that the dialectical process goes through interaction and isolation of individuals, contextual conditions favorable to the crime, a process of communication, direction of motives, impulses and rationalization of attitudes, with frequency, duration, interest and intensity.
