Abstract
O presente trabalho visa elucidar a complexa relação entre cidadania e nacionalidade, elementos frequentemente confundidos na doutrina jurídica. Através de uma análise detida, este estudo busca compreender a evolução conceitual do direito à cidadania, à luz do direito internacional, distinguindo-o claramente da nacionalidade. Adicionalmente, aborda a problemática da apatridia e suas repercussões na dignidade humana, destacando as consequências práticas na vida dos indivíduos afetados. O objetivo geral é analisar o instituto da cidadania e como se operacionaliza o exercício dos direitos a ela associados nos ordenamentos jurídicos brasileiro e português. Os objetivos específicos incluem a compreensão do conceito de nacionalidade, a delimitação do conceito de cidadania, a distinção entre cidadania e nacionalidade, a clarificação do conceito de apátrida, além de entender os mecanismos de atribuição de nacionalidade e do exercício dos direitos de cidadania em ambos os ordenamentos jurídicos. A metodologia adotada consistiu numa revisão bibliográfica de literatura especializada e na análise de documentos legislativos e jurisprudenciais relevantes de Brasil e Portugal. Os resultados indicam uma evolução significativa nos conceitos de cidadania e nacionalidade, refletindo as mudanças sociopolíticas e as exigências do direito internacional. A discussão sublinha a importância de distinguir entre cidadania e nacionalidade para uma compreensão plena dos direitos inerentes a cada instituto, além de apontar para a necessidade de políticas eficazes que mitigem os problemas relacionados à apatridia. Em conclusão, este estudo contribui para uma compreensão dos mecanismos legais que regem a cidadania e a nacionalidade nos contextos brasileiro e português, destacando a importância de uma abordagem jurídica inclusiva e adaptada às realidades contemporâneas.
This paper aims to elucidate the complex relationship between citizenship and nationality, elements that are often confused in legal doctrine. Through a detailed analysis, this study seeks to understand the conceptual evolution of the right to citizenship in the light of international law, clearly distinguishing it from nationality. In addition, it addresses the problem of statelessness and its repercussions on human dignity, highlighting the practical consequences for the lives of the individuals affected. The general objective is to analyse the institute of citizenship and how the exercise of the rights associated with it is operationalised in the Brazilian and Portuguese legal systems. The specific objectives include understanding the concept of nationality, delimiting the concept of citizenship, distinguishing between citizenship and nationality, clarifying the concept of statelessness, as well as understanding the mechanisms for attributing nationality and exercising citizenship rights in both legal systems. The methodology adopted consisted of a bibliographical review of specialised literature and an analysis of relevant legislative and case law documents from Brazil and Portugal. The results indicate a significant evolution in the concepts of citizenship and nationality, reflecting socio-political changes and the demands of international law. The discussion emphasises the importance of distinguishing between citizenship and nationality for a full understanding of the rights inherent in each institute, as well as pointing to the need for effective policies to mitigate the problems related to statelessness. In conclusion, this study contributes to an understanding of the legal mechanisms governing citizenship and nationality in the Brazilian and Portuguese contexts, emphasising the importance of an inclusive legal approach adapted to contemporary realities.
