Uma análise do direito ambiental na contemporaneidade: aspectos jurídicos-sociais e os instrumentos para se frear o avanço da degradação ambiental

Abstract

A humanidade vem utilizando os recursos provenientes da natureza de maneira irresponsável há certo tempo e o meio ambiente sofre as consequências dessa irresponsabilidade, dando sinais de esgotamento. Queimadas na Austrália e região Amazônica, rompimento de barragens e aquecimento global são só alguns dos sinais desse esgotamento. O presente trabalho possuiu o intuito de analisar alguns instrumentos jurídicos e sociais no combate à degradação ambiental, tanto repressivos quanto preventivos. Para isso foi adotado a metodologia qualitativa, com análises da doutrina sobre o tema, especialmente utilizando autores portugueses e brasileiros, bem como a utilização de dissertações e teses de doutorado. O trabalho foi estruturado da seguinte forma: o primeiro capítulo abordou o direito ambiental em âmbito internacional, trazendo características e princípios, bem como a conexão entre direito ambiental e direitos humanos. O segundo capítulo focou no direito ambiental no Brasil, sua equiparação com os direitos fundamentais e desdobramentos infraconstitucionais, também foi analisado o dano ambiental no seu plano jurídico e prático. Por fim, o terceiro capítulo possuiu o intuito de tratar sobre o direito ambiental na prática, passando por iniciativas ambientais em Portugal e as diretrizes europeias e portuguesas sobre o meio ambiente. Firs in Australia and the Amazon region, dam failures and global warming are just some of the signs of this depletion. The present word had intention of analyzing some legal and social instruments in the fight against environmental degradation, both repressive and preventive. For this, a qualitative methodology was adopted, with analysis of the doctrine on the subject, especially using Portuguese and Brazilian authors, as well as the use of dissertations and doctoral theses. The work was structured as follows: the first chapter addressed environmental law at an international level, bringing characteristics and principles, as well as the connection between environmental law and human rights. The second chapter focused on environmental law and human rights. The second chapter focused on environmental law in Brazil, its equivalence with fundamental rights and infra-constitutional developments, environmental damage was also analyzed in its legal and practical plan. Finaly, the third chapter aimed to deal with environmental law in practice, going through environmental initiatives in Portugal and the European and Portugueses guidelines on the environment.
