Biography
Nasceu no Porto, em 1984, é Professora Auxiliar, Doutorada, Mestre e Licenciada em Direito. Docente universitária desde 2009, inicialmente contratada como Assistente, tendo atualmente a categoria de Professora Auxiliar. É Coordenadora do 2º Ciclo de Estudos em Direito da Universidade Portucalense Infante D. Henrique desde 2017. É Coordenadora do curso de preparação para op CEJ - Ingresso nos TAF'S, desde a sua 1ª edição. Lecciona Unidades Curriculares relacionadas com o Direito Administrativo, substantivo e adjetivo, Direito do Urbanismo e Ambiente na Universidade Portucalense Infante D. Henrique e na Escola de Direito da Universidade do Minho. Leccionou também a Unidade Curricular de Direito do Ambiente e Urbanismo no âmbito do Mestrado em Gestão Autárquica no Instituto Politécnico do Cávado e do Ave (IPCA). Participa em projectos de investigação na área da Ciência Jurídica, em Portugal e no estrangeiro. A investigação que desenvolve centra-se na área do Direito Administrativo, especialmente, da arbitragem administrativa e arbitragem de investimento estrangeiro.

The arbitration, for all the inherent advantages, such as swiftness, arbitrators’ specialise skills and impartiality sets a pacifier tool for the interest in account. Safeguarded the public interest, we face the problem of the confidentiality in the arbitration. The urgent development of impelling mechanisms concerning transparency, guaranty and protection of the interest in account, reveals itself urgent. Through a bibliography review, we will dense the state of art, by going through the several solutions concerning, and pointing out the most suitable. Through the jurisprudential analysis we will point out the solution for the conflict confidentiality/public interest. The transparency, inextricable from the public interest, imposes the arbitration process can be open to all citizens. Transparency rules have been considered at the UNCITRAL in attempting to conciliate the necessity of publicity and the public interest, however still insufficient. The arbitration of foreign investment carries consequences to the citizens of the State. Articulating mechanisms between the arbitral procedures secrecy and the public interest should be adopted. The arbitration of foreign investment, being a tertius genius between the international arbitration and the administrative arbitration would claim its own regulation in each and every States where the confidentiality rules and its exceptions could be identified. One should enquiry where the limit of the citizens’ individual rights protection and the public interest should give way to the principle of transparency.Publication Open Access Confidentiality in foreign investment arbitration and the public’s interest2016 - Magalhães, BárbaraDue to the actual economic and political European situation as well as economic globalization there has been an increase of foreign investment, promoted by the liberalization of market and capitals with the objective of promoting economical growth in the States. The investors find many obstacles such as public expropriations, tax increase, restrictions upon the withdraw of foreign investment. These situations can became litigious. The foreign investment arbitration, as an alternative for resolution of litigious, due to all of the advantages, such as efficiency, specialization of the arbitrators and impartiality are a big incentive to foreign investment. Although, the confidentiality in foreign investment arbitration imposes some questions. In this sense, the United Nations Commission in International Trade Law (UNCITRAL) in 2013, having in mind the public interest referring to the arbitrations enacted some transparency rules. This is a model law that is a Soft Law, allowing States to adopt these measures internally or complementing there procedures with some norms instilled in the model law. On other hand, it´s urgent to create mechanisms that are effective in transparency, on the other hand protect the public interest and the guaranty of protection of the investors’ interest. For we wish to find a solution that articulates the transparency principle and public interest in arbitral procedure. We want to show case through juridical arbitral analysis, which is the best criteria to solve the conflict between the confidentiality of arbitral procedure/public interest. The foreign investment juridical relations impose just as in international contracts, confidentiality, proper for arbitration. However, due to the fact that one of the subjects is the State and the only interest, it must have is the public interest. Thus should observe the principle of transparency as it is one of the main principles of the administrative law. In this sense there should be an adequate alternative solution for resolving conflicts, furthermore to allow all subjects to follow the arbitral procedure. The arbitral awards that involve the States and foreign investors can origin profound consequences for citizens, for example, forcing the administration to pay indemnities witch will have negative consequences to the State’s budget, and this brings negative effects to our communities. It’s important to adopt mechanisms in the national supra national legislation that level the arbitral procedure secrecy, without questioning the public interest in foreign investment. It is important to balance all the interests at stake and find a solution that does not harm foreign investment and also protects the public interest.Publication Open Access Electronic administration: Brief reflection on a new administration model2018 - Figueiras, Cláudia; Magalhães, BárbaraThe article 14 of the Code of Administrative Procedure (CPA), approved by Decree-Law no. 4/2015, of January 7, is entitled "Principles applicable to electronic administration". This article comes with the approval of our new Code of Administrative Procedure and for the first time determines in paragraph 1 that the services of the Public Administration should, in the performance of their activity, use electronic means. It should be noted that in that provision the legislator uses the word ‘should' and not 'can'. This means that the Administration have no choice. The Public Administration is forced to use electronic means, unless it is not possible. The legislator establishes an obligation of facere, whose objectives are the greater efficiency and administrative transparency, as well as a greater approximation of the services to the population. To achieve this purpose we will discuss the traditional method and its limitations to the challenges of law in the era of globalization. We will emphasize the urgent need to implement the case study method in Portuguese law schools, as an instrument that enhances the active participation of the student, protagonist in the process of learning and knowledge acquisition. It is intended that students develop critical thinking and be able to reflect on their own learning process. A review of the literature will be carried out, which will seek to contextualize, at present, the reflexivity with the pedagogical objective. Use shall be a deductive reasoning, based on the general reality of teaching to learning the law, underlining the importance of the case study method for the development of didactic and pedagogical dimension. A primeira, em saber se existe um critério uno e coerente que permita precisar quais as matérias arbitráveis em sede de Direito Administrativo. A segunda prende-se com a delimitação do âmbito da arbitrabilidade do ato administrativo, sobretudo nas questões relacionadas com a legalidade do mesmoPara compreender-se o alcance desta problemática impõe-se-nos uma incursão pelo instituto da arbitragem em geral. Traçaremos os contornos do instituto em geral, sua distinção de figuras afins, exploração das várias tipologias e sua natureza jurídica. Seguidamente, procederemos a uma contextualização do instituto no âmbito do Direito Administrativo, procurando averiguar as soluções legais consagradas. Compreendidas estas, discutiremos o âmbito objetivo e subjetivo da arbitragem, o processo arbitral, procurando discorrer sobre questões controversas, v.g., a (ir)recorribilidade das decisões arbitrais e a equidade na arbitragem administrativa. Contudo, perante à incoerência lógica do regime jurídico vigente, constataremos da necessidade da intervenção do legislador para uma uniformização critério legal aplicável.Publication Open Access Scope and limits of the administrative act arbitrability2019-03 - Moreira, Fátima Castro; Magalhães, BárbaraThe material scope of arbitration in administrative matters has recently been considerably enlarged, especially in regards to the administrative act. It was recognized that the Arbitral Tribunal has the power to appreciate the legality of an administrative act. Traditionally, the legality of administrative acts was reserved for state courts. However, the legal incongruity was notorious. Article 180 (1) (c) of the Code of Procedure of the Administrative Courts (CPTA), 2002, provided that arbitral tribunals could enounce "matters relating to administrative acts that could be revoked without grounds for invalidity". We could diagnose two types of legal failures. First, within Administrative Law, it was incomprehensibly admissible to arbitrate the legality of administrative acts pertaining to the contractual sphere and exclude all others from the control of arbitration law. The other flaw suffered by the regime of arbitrability of administrative acts related to the possibility of arbitrability of tax acts3 and the imposition of strong limitations on the control of the legality of administrative acts in Administrative Law. The revision of the CPTA in 2015 implied a change in the legislative paradigm in the matter of administrative arbitration, providing for the possibility by the arbitral tribunals of assessing the legality of the administrative act, thus putting an end to a doctrinal dispute about the admissibility of the same. However, a literal interpretation of the precept would lead us to subsume within the jurisdiction of the arbitral tribunals the assessment of the legality of any administrative act. Considering the legislative scope of the legal prediction enunciated, the present work will have as its objective to answer three key questions. The first is to assess to what extent the arbitral tribunals may rule on the merit and legality of the administrative act. The second is to determine whether all administrative acts are arbitrable. The third concerns the search for a criterion of arbitrability of the administrative act, especially in matters related to legality.
