Abstract
O presente estudo tem por objetivo discutir o processo de adoção no Brasil e em
Portugal, levantando suas principais similaridades e diferenças. Para tanto, discute o
processo de adoção no Brasil e em Portugal, apresentando conceito, evolução histórica,
princípios aplicáveis, características, requisitos, tipos de adoção, atuais mecanismos
vigentes, habilitação, principais deficiências e adoções consideradas ilegais, além de
abordar o problema da devolução de crianças. Complementarmente, levanta as
similaridades e principais diferenças entre o processo de adoção no Brasil e em Portugal
e finaliza apresentando algumas sugestões que podem trazer melhorias aoprocesso
utilizado por ambos os Países. Como metodologia, foi utilizada a pesquisa bibliográfica,
a partir de materiais já publicados, a exemplo de legislações e doutrinas que se dedicam
ao estudo sobre o tema “adoção” e seus muitos desdobramentos no Brasil e em
Portugal. Foi visto que os sistemas de adoção em Portugal e no Brasil são bastante
parecidos, ambos tendo como prioridade absoluta o melhor interesse da criança. Ambos
também padecem com a burocracia, morosidade e ausência de políticas públicas
incentivando a adoção de crianças e adolescentes normalmente preteridos, a exemplo
das crianças negras, doentes, deficientes, maiores de 6 anos ou que têm irmãos
também à espera de adoção já que em Portugal e no Brasil, prioriza-se a adoção dos
irmãos por uma mesma família. Por fim concluiu-se pela necessidade de políticas
públicas que incentivem a adoção responsável e que abram mais oportunidades para
que crianças institucionalizadas tenham maiores chances de conviverem em uma
família.
The present study aims to discuss the adoption process in Brazil and Portugal, raising their main similarities and differences. Therefore, it discusses the adoption process in Brazil and Portugal, presenting the concept, historical evolution, applicable principles, characteristics, requirements, types of adoption, current mechanisms in force, qualification, main deficiencies, and adoptions considered illegal, in addition to addressing the problem of return of children. In addition, it raises the similarities and main differences between the adoption process in Brazil and Portugal and ends with some suggestions that can bring improvements to the process used by both countries. As a methodology, bibliographic research was used, based on materials already published, such as legislation and doctrines that are dedicated to the study of the theme "adoption" and its many consequences in Brazil and Portugal. It was seen that the adoption systems in Portugal and Brazil are very similar, both having the best interest of the child as an absolute priority. Both also suffer from bureaucracy, slowness and the absence of public policies encouraging the adoption of children and adolescents who are normally neglected, such as black, sick, disabled children, over 6 years of age or who have siblings also waiting for adoption since in Portugal and in Brazil, priority is given to the adoption of siblings by the same family. Finally, it was concluded that there is a need for public policies that encourage responsible adoption and that open up more opportunities for institutionalized children to have greater chances of living in a family.
