A noção de jurisdição para efeitos de interpelação de recurso prejudicial: a questão dos tribunais arbitrais.

Abstract

Um juiz nacional, ao interpretar uma disposição comunitária ou a validade de um ato da União, tem a faculdade, quando não seja mesmo obrigado, de elaborar uma questão prejudicial e remetê-la ao Tribunal de Justiça da União Europeia através do recurso prejudicial. Acontece que, os juízes dos tribunais arbitrais, atendendo à natureza e características do tribunal, muitas vezes é-lhes negado o referido recurso, por não ser reconhecida competência para o efeito.

A national judge, when interpreting a community provision or the validity of an act of the Union, has the right, when not obliged, to draw up an issue and send it to the Court of justice of the European Union through preliminary rulings. Turns out, that judges of arbitration courts, attending to the nature and characteristics of the court, are often denied that action, because their competency is not recognized for that effect.
