Abstract
Vivemos numa sociedade de consumo, de comércio internacional, de circulação
de pessoas e bens a uma escala sem precedentes, as distâncias esvanecem-se mais
que nunca. A evolução dos meios de transporte levou a que como exemplo, um
hipermercado, seja uma autêntica “sociedade das nações” de tantas proveniências os
seus produtos terem. Esse transporte é feito principalmente por empresas
transnacionais, e o capital envolvido é gigantesco, tanto nos meios de transporte como
nas mercadorias em si mesmas, tornando indispensável a criação de seguros
específicos. Todo este tráfego internacional toma contacto com diversos
ordenamentos jurídicos, cada um mais díspar que o outro, criando sérios desafios aos
diversos “atores” (produtores, exportadores, transportadores, seguradoras,
importadores). Assim, foram feitas múltiplas tentativas a nível internacional de
aproximação ou uniformização dos regimes legais, desde Convenções internacionais
até ao Direito Comunitário tanto para o contrato de transporte de mercadorias como
para o contrato de seguro. Mas as Convenções têm o problema de apenas vincular os
Estados que as ratifiquem, ou dependem da ratificação de um número mínimo de
Estados para entrar em vigor. E em virtude disso temos múltiplas regulamentações
vigentes, que dificultam sobremaneira a fixação do regime aplicável ao tráfego
internacional de mercadorias e ao contrato de seguro, e a Globalização está também a
criar novos desafios. Cremos que por tudo isto se justifica um estudo do contrato de
seguro de mercadorias com a indispensável abordagem ao contrato de transporte.
We live in a consumer society, international trade, movement of people and goods on an unprecedented scale, where distances evanesce more than ever. As an example, the evolution of transports led to a hypermarket being an authentic "society of nations", as its products are of different sources. That transport is mostly done by transnational corporations, and the capital involved is massive, both in means of transport as well as in the goods themselves, making it essential to set up specific insurances. All this international traffic comes into contact with several legal systems, each one being more different than the other, creating serious challenges to the various 'actors' (producers, exporters, transporters, insurance companies, importers), multiple attempts were made at an international level of approach or standardization of legal systems, from International Conventions to Community Law for both freight contracts as well as insurance contracts; however Conventions have an issue with regards to being only binding on countries that ratify them, or of depending on the ratification of a minimum number of States to come into effect. As a result, there are multiple existing regulations that interfere with fixing the applicable regimen for international trading of goods and for insurance contracts, and the Globalization is also creating new challenges. For all these reasons, we believe that it is justified a study of freight insurance contract with the indispensable approach to the contract of carriage.
