RESUMO
Esta dissertação trata da temática do assédio moral organizacional no cenário
da Revolução 4.0, tendo como objetivo identificar os impactos das inovoções
tecnológicas nas práticas de assédio moral no mundo do trabalho. Para alcançar o
intento da pesquisa é realizada a análise dos aspectos téoricos do assédio moral, bem
como o tratamento jurídico da matéria no âmbito da OIT, da União Europeia e em
Portugal. Além de focar nessa discussão, é feita a averiguação dos reflexos da
Revolução 4.0 no modo de organização do trabalho. Prossegue-se com a análise
crítica da correlação entre Revolução Tecnológica 4.0 e as novas práticas de assédio
moral organizacional, em especial nas plataformas digitais e teletrabalho. Verifica-se
que vigilância e controle ostensivo do empregador, por meio das tecnologias da
Revolução 4.0, acarretam uma maior cobrança por resultados e hiperconectividade do
empregador, tornando muito tênue os limites entre a vida profissional e pessoal do
trabalhador. Para frear o referido fenômeno, propõe-se o reavivamento das bases
históricas do Direito do Trabalho baseada na centralidade no ser humano e na
dignidade do trabalhador, por meio do fomento ao trabalho decente. É com base
nessa perspectiva que será possível encontrar soluções mais eficazes para prevenir o
assédio moral nas organizações contemporâneas.
This dissertation deals with the issue of organisational bullying in the context of Revolution 4.0, with the aim of identifying the impact of technological innovations on moral harassment practices in the world of work. In order to achieve this aim, the theoretical aspects of moral harassment are analysed, as well as the legal treatment of the issue within the scope of the ILO, the European Union and Portugal. In addition to focusing on this discussion, the reflections of Revolution 4.0 on the way work is organized are investigated. This is followed by a critical analysis of the correlation between Technological Revolution 4.0 and the new practices of organizational moral harassment, especially on digital platforms and teleworking. It emerges that the employer's surveillance and overt control, through the technologies of Revolution 4.0, have led to greater demands for results and hyperconnectivity on the part of the employer, blurring the boundaries between the worker's professional and personal life. In order to curb this phenomenon, it is proposed to revive the historical foundations of labour law based on the centrality of the human being and the dignity of the worker, by promoting decent work. It is from this perspective that it will be possible to find more effective solutions to prevent moral harassment in contemporary organizations.
