Abstract
Inúmeras vezes, quando me interrogam sobre o tema da minha dissertação retorquiam
instantaneamente: “administrativo e união europeia não combina”. E por
achar absolutamente o contrário decidi abordar este tema. Abordar o quão a criação
do Direito (Processual) Administrativo é, em tudo, semelhante à criação da ordem jurídica
supranacional da União Europeia. Essencialmente porque ambas ordens jurídicas
efetivam o exercício de poderes de soberania face a cidadãos que querem ver os seus
direitos protegidos.
Ao longo dos anos, os particulares e os Estados-Membros tiveram de se ajustar
àquilo que há uns anos atrás viria a ser o nosso dia-a-dia: a União Europeia baseada
na cooperação e lealdade de todos os seus agentes.
Pelo exposto, a presente dissertação tem em vista perceber, numa primeira fase,
quais as bases em que assenta o nosso Direito (Processual) Administrativo, numa
segunda fase evidenciar a construção e, respetivo, desenvolvimento de um ordenamento
jurídico inovador: o Direito da União Europeia e quais as bases nacionais a que
este lançou mão para a criação de princípios, organizações, procedimentos e processos.
Countless times, when asked about the topic of my dissertation, people, intuitively, retort that administrative and European union do not match. I, on the other hand, plead the absolute opposite, therefore I chose to approach this subject matter. Firstly, I will address how the creation of the supranational (Procedural) Administrative Law reflects, in every way, the sum of European’s Union different administrative laws. Mostly, because both legal orders fulfill the exercise of Sovereign powers towards citizens, who want to see their rights protected. Over the years, State-Members and their citizens had to adapt themselves to what would become own day-to-day, namely the European Union, with all its values, namely cooperation and loyalty among all its agents. Consequently, I intend, I’m a first phase, to analyze which foundations were designed to guide Administrative (Procedural) Law. Secondly, I will highlight the construction and its respective development of an innovative legal system, referring the European’s Union Law and which national basis were used to create its principles, organizations, procedures and processes.
