Abstract
Existe uma perceção generalizada de que as greves, nomeadamente no setor
público ou em empresas privadas responsáveis pela produção ou prestação de serviços
básicos para a sociedade, afetam de forma mais incisiva os cidadãos do que as entidades
empregadoras propriamente ditas.
O objetivo principal deste trabalho é explorar hipóteses de aplicação de alternativas à
convocação direta da greve, como por exemplo a figura da arbitragem, já usada noutros
contextos, como forma de conciliar as partes por forma a evitar os prejuízos sociais e
económicos para terceiros e para o próprio tecido económico-social provocados pela
greve.
Numa sociedade democrática é indiscutível o direito à greve. No entanto, quando se
realiza uma greve, sobretudo em áreas sensíveis como a saúde ou os transportes, os
direitos constitucionais dos cidadãos afetados são colocados em causa. Importa, por
isso, perceber até que ponto uma minoria pode pôr em causa esses direitos e o normal
funcionamento da vida em sociedade.
Este trabalho começa por fazer uma resenha de alguns dos conceitos mais importantes
para analisar a temática da greve e, de seguida, um breve enquadramento jurídico e
histórico da greve e do sindicalismo em Portugal.
Como suporte à fundamentação da perspetiva que se pretende aprofundar, realizou-se
um estudo de caso baseado num inquérito sobre o sindicalismo e o direito à greve.
Entendemos que a arbitragem, se incluída na fase do pré-aviso de greve, poderia ter a
enorme vantagem de evitar prejuízos económicos e sociais quer os sociais para os
cidadãos, direta ou indiretamente afetados, com claras vantagens para a economia
nacional e para a sociedade civil.
There is a widespread perception that strikes, particularly in the public sector or in private companies responsible for producing or providing basic services to society, affect the citizens more incisively than the entities or companies themselves. The main objective of this work is to explore the hypothesis of applying alternatives to the direct call of the strike, as for example the figure of the arbitration, similar to what happens in other areas of the Law, as a way to conciliate the parties in order to avoid the social and economic and social fabric caused by the strike. In a democratic society the right to strike is indisputable. However, when a strike occurs, especially in sensitive areas such as health or transport, the constitutional rights of affected citizens are called into question. It is therefore important to realize the extent to which a minority can undermine these rights and the normal functioning of life in society. This paper begins with a review of some of the most important concepts to analyze the theme of the strike and then a brief legal and historical framework of the strike and syndicalism in Portugal. In support of the basis of the perspective that is intended to be further developed, a case study based on a survey on trade unionism and the right to strike was carried out. We understand that Arbitration, if included in the pre-strike phase, could have the enormous advantage of avoiding economic, but above all social, harm to those involved and to citizens, directly or indirectly affected; soon would, therefore, be advantageous for the economy and for society.
