A regularização fundiária urbana e o acesso à moradia digna

Abstract

O direito à moradia é um direito social fundamental previsto no âmbito internacional e nas Constituições do Brasil e de Portugal, entretanto, a história nos mostra que o Estado não foi capaz de suprir adequadamente essa necessidade humana, o que trouxe o problema de déficit habitacional e da irregularidade fundiária, que tem assolado tanto o Brasil quanto Portugal, desde que o aumento da população urbana ocorreu de forma expressiva, em especial após o período do êxodo rural. O presente trabalho objetiva compreender e caracterizar o direito à habitação, no âmbito internacional e interno de cada país, à função social da propriedade e os instrumentos da Regularização Fundiária Urbana, no Brasil e da Reconversão Urbana, em Portugal, como forma de atender esse direito, trazendo o conceito, procedimentos e a responsabilidade dos entes públicos e da sociedade para a sua efetivação. The right to housing is a fundamental social right foreseen at the international level and in the Constitutions of Brazil and Portugal, however, history shows us that the State was not able to adequately supply this human need, which brought the problem of housing deficit and land tenure irregularity, which has been plaguing both Brazil and Portugal, since the increase in the urban population occurred significantly, especially after the period of the rural exodus. The present work aims to understand and characterize the right to housing, at the international and domestic level of each country, to the social function of property and the instruments of Urban Land Regularization, in Brazil and Urban Reconversion, in Portugal, as a way to meet this right, bringing the concept, procedures and the responsibility of public entities and society to their effectiveness.
