A inteligência artificial no direito e processo administrativo

Abstract

O Direito, em particular o Direito Administrativo, está em constante evolução e adaptação à sociedade atual e a todas as suas contingências. Parece-nos fazer todo o sentido conjugar o Direito e Proceso Administrativo com a Inteligência Artificial. A escolha do tema prende-se com a importância do binómio tecnologia/informática e direito, já que o direito é visto por todos como uma área burocrática e vagarosa. A inclusão da inteligência artificial no processo decisório da administração pública é inevitável, tal como conseguimos verificar, principalmente, durante a vigência da pandemia covid-19. Pelo exposto, a presente dissertação tem em vista perceber, em que consiste a Inteligência Artificial, como é que esta se relaciona, em termos práticos com o direito, quais os desafios que tem pela frente e o seu impacto nas profissões jurídicas, sobretudo, no exercício da advocacia e da magistratura. Law, specifically Administrative Law, is constantly evolving and adapting to society and all its contingencies. In an ever-changing world, it makes perfect sense to combine Administrative and Procedure Law with Artificial Intelligence. The selection of this topic was due to the importance of the technology/IT binomial and the Law since the latter one is regarded by all the public as too bureaucratic and with a low efficiency. Artificial intelligence was first introduced during the COVID-19 pandemic in the decisive process of public administration. Based on the above, this dissertation aims to understand what Artificial Intelligence consists of, how it relates, in practical terms with the Law, what challenges lie ahead, and its impact on the legal professions, especially in the practice of law and judiciary.
