O direito à liberdade de expressão e o reconhecimento da sua tripla dimensão no âmbito internacional de direitos humanos

Abstract

Esse trabalho teve por intuito a realização de um estudo sobre o direito à liberdade de expressão no Brasil e nos sistemas regionais interamericano e europeu, para assim poder ser trabalhado a Tripla Dimensão desse direito, que seria o viés transpolítico e suas aplicações concretas. Foi efetuado um minucioso estudo da bibliografia disponível aplicável, e um estudo comparado dos diversos sistemas envolvidos. Com base nisso, optou-se por dividir o estudo em quatro capítulos: No primeiro analisa-se o contexto histórico e a consagração dos direitos humanos. No segundo, aborda-se genericamente os direitos humanos e os direitos fundamentais, e mais especificadamente o direito à liberdade de expressão, exemplificando situações violadoras desse direito no Brasil. No terceiro, analisa-se a jurisprudência da Corte Interamericana de Direitos Humanos e do Tribunal Europeu de Direitos Humanos no que a esse direito respeita, identificando-se um padrão que se aplica no quarto capítulo, a várias situações concretas da atualidade, finalizando-se com as conclusões.

This work aimed to carry out a study on the right to freedom of expression in Brazil and in the inter-American and European regional systems, in order to be able to work on the Triple Dimension of this right, which would be the trans-political bias and its concrete applications. A thorough study of the applicable available bibliography was carried out, and a comparative study of the various processed systems was carried out. Based on this, it was decided to divide the study into four chapters: In the first, the historical context and the consecration of human rights are analyzed. In the second, human rights and fundamental rights are generally addressed, and more specifically the right to freedom of expression, exemplifying the violators of that right in Brazil. In the third, the jurisprudence of the Inter-American Court of Human Rights and the European Court of Human Rights is analyzed, which does not respect this right, identifying a pattern that applies in the fourth chapter to various concrete situations today, ending with the conclusions.
