Abstract
O presente trabalho tem como objetivo o estudo do regime jurídico do direito de
arrependimento (legalmente designado por “direito de livre resolução”) nos contratos
celebrados à distância e nos contratos celebrados fora do estabelecimento comercial
regulado no Decreto-Lei 24/2014, de 14 de fevereiro, nos artigos 10.º ao 17.º.
O diploma assenta na proteção do consumidor quer nos contratos celebrados à
distância quer nos contratos celebrados fora do estabelecimento comercial. Nos
primeiros, o consumidor pode deparar-se com bens fornecidos ou serviços prestados
pelo profissional que não correspondem às suas expectativas, aquando da celebração
do contrato, já que estes foram fornecidos ou prestados sem que ele tenha previamente
acedido a eles. Nos segundos, o consumidor é abordado pelo profissional, por exemplo,
no seu domicílio ou no local de trabalho e sofre pressão que o leva a celebrar o contrato
num local onde não esperava ter sido abordado, acabando eventualmente por tomar
uma decisão precipitada.
O direito de livre resolução permite ao consumidor desvincular-se do contrato
através de uma declaração unilateral, sem precisar de invocar qualquer fundamento e
sem incorrer em quaisquer custos, exceto o da devolução. Este direito de livre resolução
ou direito de arrependimento constitui umas das principais medidas de proteção do
consumidor previstas na lei, não obstante, existem diversas exceções que limitam a
utilização deste direito, atualmente consagradas no artigo 17.º do diploma legal.
The purpose of this paper is to study the legal regime of the right of withdrawal (legally referred to as the “right of withdrawal”) in distance and off-premises contracts published in Decree-Law 24/2014, of February 14, in articles 10 to 17. The law is based on consumer protection in both distance and off-premises contracts. In the former, the consumer may find that the goods supplied, or services provided by the professional do not meet his expectations when he enters the contract, as they have been supplied or provided without his prior access to them. In the second case, the consumer is approached by the professional, for example at home or at work, and is pressured into concluding the contract in a place where he didn´t expect to have been approached, possibly ending up making a hasty decision. The right of withdraw allows the consumer to withdraw from the contract through a unliteral or one-sided declaration, without having to invoke any grounds and without incurring any costs, except for the return. This right of withdrawal or right of regret is one of the main consumer protection measures provided for in the Consumer Law, although there are several exceptions that limit the use of this right, currently enshrined in Article 17 of the Law.
