Abstract
Há um paradoxo instigante ao abordar-se a temática do acesso do cidadão à justiça,
quando constata-se que, por um lado, assegura-se a este cidadão o direito do acesso à
Justiça, através do princípio da inafastabilidade do controle jurisdicional ou o princípio
do direito de ação, como direito de primeira dimensão, previsto no art. 5º, XXXV da
Constituição Federal, ao mesmo passo que, por outro lado, tal acesso à justiça sucumbe
ao volume elevado e excedente de ações protocoladas e processadas na justiça, em
quantidade desproporcional à capacidade do Poder Judiciário.
Como alternativa, emerge, em direção ao atendimento célere e desburocratizado destas
demandas a temática central do estudo apresentado, a prática da desjudicialização de
conflitos por vias extrajudiciais.
Pautou-se, como objetivo central, a investigação acerca da legislação, prática e
aplicabilidade, benefícios promovidos aos atores envolvidos e maior difusão das
vantagens promovidas pela prática da desjudicialização como resultado da resolução
de conflitos pela via extrajudicial.
Foram utilizadas as técnicas de revisão bibliográfica da literatura, no âmbito dos
contextos luso-brasileiros, bem como por meio da análise documental de fontes públicas
ligadas ao assunto.
Ponderados os resultados obtidos, pode-se contribuir com a reflexão sobre os
benefícios oportunizados pela desjudicialização, no sentido de desconstrução da cultura
litigiosa e ainda, para difusão de políticas voltadas para a resolução de tais conflitos de
maneira efetiva e de forma mais célere.
There is an instigating paradox when addressing the issue of citizen access to justice, when it appears that, on the one hand, this citizen is guaranteed the right of access to Justice, through the principle of non-exhaustiveness of judicial control or the principle of the right of action, as a right of first dimension, provided for in art. 5, XXXV of the Federal Constitution, while, on the other hand, such access to justice succumbs to the high and excess volume of lawsuits filed and processed in court, in an amount disproportionate to the capacity of the Judiciary. As an alternative, the central theme of the presented study emerges, towards the swift and unbureaucratic fulfillment of these demands, the practice of dejudicializing conflicts by extrajudicial means. The main objective was to investigate the legislation, practice and applicability, benefits promoted to the actors involved and greater dissemination of the advantages promoted by the practice of judicialization as a result of conflict resolution through extrajudicial means. Bibliographic literature review techniques were used in the context of Luso-Brazilian contexts, as well as through documentary analysis of public sources linked to the subject. After weighting the results obtained, it is possible to contribute to the reflection on the benefits provided by the dejudicialization, in the sense of deconstructing the litigious culture and also, for the dissemination of policies aimed at resolving such conflicts in an effective and faster way.
