Abstract
A proposta desta dissertação foi levantar, por meio de uma análise comparativa, se o dano moral previdenciário é capaz ou não de gerar a responsabilidade civil extracontratual do Estado. O interesse por esta temática se justifica na medida em que várias são as formas de lesão aos direitos da personalidade e dignidade da pessoa humana durante o trata do Estado na análise, concessão e implantação dos benefícios previdenciários. Sendo assim, para uma análise adequada, confrontou-se, neste estudo, doutrina, legislação e jurisprudência brasileira e portuguesa, na qual foram demonstradas suas semelhanças e diferenças na aplicação destes institutos em casos práticos retirados da jurisprudência brasileira. O trabalho se baseou em uma metodologia descritiva e comparativa, expondo seus fatos e variáveis, mostrando sempre a realidade investigada, coletando informações bibliográficas, legislativas e jurisprudências dos Tribunais brasileiros. Por fim, concluiu-se no sentido de que tanto a responsabilidade civil extracontratual do Estado brasileiro como português estão amparadas em suas constituições. Todavia, as diferenças conceituais e evolutivas levam a consequências práticas consideráveis no momento da responsabilização do Estado. Ressalvadas estas diferenças, chega-se ao entendimento final que a responsabilização do Estado frente ao dano decorrente do dano moral previdenciário é totalmente possível. Isso porque o Estado tem por obrigação constitucional de zelar e proteger os riscos sociais, que possuem natureza de direito fundamental. Uma vez o Estado agindo de forma ilícita e extrapolando o mero dissabor, o dano moral previdenciário estará configurado, ressalvas as peculiaridades de cada caso em concreto.
The purpose of this dissertation was to raise, through a comparative analysis, if the social security moral damage is capable or not of generating the extra-contractual civil liability of the State. The interest in this theme is justified insofar as there are several forms of damage to the rights of the personality and dignity of the human person during the State's analysis, concession and implementation of social security benefits. Therefore, for an adequate analysis, Brazilian and Portuguese doctrine, legislation and jurisprudence were confronted in this study, in which their similarities and differences were demonstrated in the application of these institutes in practical cases taken from Brazilian jurisprudence. The work was based on a descriptive and comparative methodology, exposing its facts and variables, always showing the investigated reality, collecting bibliographic, legislative and jurisprudence information from the Brazilian Courts. Finally, it was concluded that both the non-contractual civil liability of the Brazilian and Portuguese States are supported in their constitutions. However, conceptual and evolutionary differences lead to considerable practical consequences at the time of State accountability. With the exception of these differences, we arrive at the final understanding that the State's responsibility for the damage resulting from social security moral damage is totally possible. This is because the State has a constitutional obligation to watch over and protect social risks, which have the nature of a fundamental right. Once the State acts illegally and extrapolates the mere unpleasantness, the social security moral damage will be configured, except for the peculiarities of each specific case.
