Abstract
O trabalho que vai ser efectuado, assenta no interesse sobre o que se está a passar na
Catalunha em particular e na Espanha, no que às pretensões dos catalães diz respeito.
Para se perceber melhor as razões que estão por detrás de toda a movimentação catalã e
respectiva argumentação, mais incisiva no presente século, iniciou-se um estudo histórico com
início há centenas de anos atrás – mais precisamente desde que a Catalunha começou a ser
referenciada nos anais da história – até aos nossos dias, a fim de que se pudesse aferir dos
motivos invocados, da sua veracidade e quão fortes se foram tornando até à actualidade, para
suportarem as reivindicações catalãs na luta pela autonomia e independência face a Espanha.
Foram analisados os vários domínios que ocorreram sobre aquele território e seu povo ao
longo dos séculos e como se foi moldando um nacionalismo histórico na Catalunha, face a uma
Espanha que só foi nação bem mais tarde,, no século XIX. Estudou-se a luta constante da
Catalunha em prol da república, com especial incidência no século XX, em que o seu povo
sofreu às mãos de Franco, desde a Guerra Civil de Espanha, até ao fim do franquismo e do
regresso da democracia, ocorrido já na segunda metade da década de 70.
A partir daí, a sua luta passará a ser bastante mais institucional, com especial incidência
nos Parlamentos Catalão e Espanhol, pelo que o estudo ir-se-á debruçar exclusivamente nas
componentes política e jurídica, uma vez que os argumentos que irão ser utilizados por ambas
as partes – catalães e governo de Madrid – andarão invariavelmente em torno de argumentos
jurídico/constitucionais, por parte de Madrid e de argumentos políticos – incidindo
essencialmente nos direitos humanos e no direito à liberdade de voto para decidir – por parte da
Catalunha, ainda que não abdiquem igualmente de esgrimir argumentos jurídicos a seu favor.
A escalada do conflito foi inevitável tendo-se chegado aos dias de hoje com uma
judicialização do mesmo que levou a um impasse e que, a meu ver, apenas poderá ser resolvido
em termos honrosos e definitivos, com cedências de ambas as partes, onde terá que ser incluído,
inevitavelmente, o direito de os catalães poderem decidir o seu destino.
The work to be carried out is based on the interest surrounding what is occurring in Spain, specifically in Catalonia, with regard to the wishes of the Catalans. In order to better understand the reasons behind the entire Catalan movement and its argumentation, which has become more incisive in the present century, a historical study began hundreds of years ago - more precisely since Catalonia began to be referenced in the annals of history - up to the present, in order to assess the reasons invoked, their veracity and how they have strengthened until the present day, to support the Catalan demands in their struggle for autonomy and independence from Spain. The various realms established in that territory and over its people throughout the centuries have been analysed, as well as how historical nationalism was shaped in Catalonia, in the face of a Spain which only became a nation much later, in the 19th century. Catalonia's constant struggle to become a republic was studied, with special emphasis on the 20th century, when its people suffered at the hands of Franco, from the Spanish Civil War, to the end of Francoism and the return of democracy, which occurred in the second half of the 1970s. From then on, their struggle became much more institutional, with particular emphasis on the Catalan and Spanish Parliaments. For this reason, the study will focus exclusively on the political and legal components, since the arguments used by both parties – the Catalans and the Madrid government - will invariably involve legal/constitutional arguments by Madrid and political ones - focusing essentially on human rights and the right to vote to decide - by Catalonia, while never abdicating the use of legal arguments in their favour. The escalation of the conflict was inevitable, with it presently reaching a state of judicialisation, leading to an impasse which, in my opinion, can only be resolved, in honourable and definitive terms, with concessions from both parties, which will inevitably include the right of Catalans to be able to decide their fate.
