O papel das Organizações Internacionais perante a identidade curda na Turquia: a ONU, a UE e o Conselho da Europa

Abstract

Desde a queda do Império Otomano, a problemática mais urgente dos curdos diz respeito ao seu reconhecimento identitário na Turquia. Por isso, o presente trabalho busca investigar o papel desempenhado por três Organizações Internacionais (OI) – a Organização das Nações Unidas (ONU), a União Europeia (UE) e o Conselho da Europa – na defesa da identidade curda e como elas são importantes no fortalecimento dessa etnia. Objetivamos pesquisar a atuação dessas organizações nas questões relativas ao reconhecimento dos curdos como grupo minoritário que necessita de visibilidade, bem como nas questões que envolvem o direito de falar em curdo, o direito à educação e à liberdade de expressão, todos necessários para dar efetividade dentro dos tribunais. Utilizando o método qualitativo e dedutivo de pesquisa, investigamos os tratados, as leis, a jurisprudência e a bibliografia que versam sobre o papel dessas OI na defesa dos direitos humanos dos curdos. No primeiro capítulo, traçamos a história da identidade curda como minoria, sua religião e suas fragilidades dentro da Turquia. O segundo capítulo abre espaço para as três OI e suas estruturas, analisando sua pertinência para a causa curda por meio de seus julgados. O último capítulo entrelaça casos no direito de ação dos tribunais que efetivam passos em favor dos curdos, dentro do sistema judicial de cada ente, tendo o Conselho da Europa o papel mais efetivo, seguido da União Europeia, que reconheceu direito de ação aos curdos na jurisprudência analisada. Since the fall of the Otoman Empire, the most urgent problem facing the Kurdish people is the recognition of their identity in Turkey. Thus, the present work aims at investigating the role played by three Internationational Organizations (IO) – the United Nations (UN), the European Union (EU) and the Council of Europe – in the defense of the Kurdish identity and their importance in the strengthening of the Kurdish cause. Our goal is to investigate the action of these organizations in recognizing the Kurdish people as a minority group in need of visibility, as well as the questions involving the right to speak Kurdish, the right to education and to free expression. Using the qualitative and deductive method, we investigate the treaties, the laws, the jurisprudence and the bibliography that deals with the role of these IO in the defense of the Kurdish people human rights. In the first chapter we draw the history of the Kurdish identity as a minority, their religion and their fragility within Turkey. The second chapter opens space for the three IO and their structures, analyzing the pertinence to the Kurdish cause through their judgments. The last chapter analyzes cases ruled in the courts that take steps in favor of the Kudish within the judicial system of each organization, with the Council of Europe having the most prominent role, followed by the European Union, that recognized the Kurdish people right to action in the jurisprudence studied.
