A evolução da legislação do registro imobiliário no Brasil e em Portugal

Abstract

A evolução histórica da representação do que vem a ser propriedade desde os primórdios da humanidade até a concepção moderna do seu conceito e legislações relacionadas, bem como a origem do registro imobiliário e seu desenvolvimento na seara legislativa até os dias atuais se constituem como eixo central de discussão nesse trabalho. As mudanças desse conceito, ao longo da evolução social humana, evidenciam que o significado de propriedade evolui com o homem e o mesmo acontece quando o assunto é a propriedade imobiliária e a legislação que a rege. A pesquisa histórica acerca dos costumes sociais e políticos do homem foi o caminho percorrido para elaborar a presente obra com o objetivo principal de demonstrar que um conceito bem delineado de propriedade e uma organizada e contundente legislação a respeito do registro imobiliário gera segurança jurídica nos negócios imobiliários. Para tanto, utiliza-se a abordagem qualitativa de pesquisa, cujo desenho metodológico caracterizou-se como uma revisão da literatura sobre o assunto, apoiada na busca de artigos e seleção de conteúdo em bases de dados e livros deste domínio. Como resultado essencial ficou constatado que o registro imobiliário bem estruturado a partir da inserção das informações necessárias e juridamente legais no número de matrícula do imóvel finda por favorecer ganhos na área econômica na medida em que baixa os custos das transações envolvendo imóveis, implicando melhoria na performance do mercado. The historical evolution of the representation of property from the beginnings of humanity to the modern conception of its concept and related legislation, as well as the origin of the real estate registry and its development in the legislative area to the present day constitute the central axis of discussion in this work. The changes in this concept, along human social evolution, show that the meaning of property evolves with man and the same happens when the subject is real estate property and the legislation that governs it. Historical research on the social and political customs of man was the path taken to prepare this work with the main objective of demonstrating that a well-defined concept of property and an organized and forceful legislation regarding real estate registration generates legal security in real estate business. Therefore, a qualitative research approach is used, whose methodological design is characterized as a literature review on the subject, supported by the search for articles and selection of content in databases and books in this domain. As an essential result, it was found that the well-structured real estate registry from the insertion of the necessary and legally legal information in the property's registration number ends up favoring gains in the economic area as it lowers the costs of transactions involving properties, implying an improvement in performance from the market.
