Abstract
Definida como um elo jurídico-político entre um Estado e um indivíduo, a nacionalidade
apresenta, simultaneamente, uma dimensão vertical e horizontal. À nacionalidade
vertical, alude-se o estabelecimento de deveres e direitos recíprocos entre o país e seus
nacionais. Enquanto isso, a nacionalidade horizontal é compreendida como o
sentimento de pertencimento às expressões culturais, às tradições e ao modo de vida
associado com determinado Estado. Em outras palavras, essa segunda manifestação
simboliza o desejo de efetivamente compor o povo de um país. Ambas subdivisões da
nacionalidade são provas da mútua lealdade entre o país e seus nacionais. É essa
especial fidelidade que autoriza o Estado a escolher critérios próprios para a concessão
de nacionalidade. Os requisitos diferem conforme o momento de vida, em que a
nacionalidade é obtida. Caso a nacionalidade seja concedida pelo estrangeiro que
deseje pertencer ao povo de um Estado após a própria nascença, estar-se-á diante da
hipótese de nacionalidade via aquisição. No específico intento de se tornar português
por essa via, será preciso compreender os critérios designados para tal em diplomas
legais portugueses. Tais requisitos são produto de uma evolução histórico legislativa
que busca – através dos séculos - responder à pergunta: quem poderá se tornar
português? A solução para essa indagação é constantemente adaptada como se
demonstra de contínuas atualizações legais acerca da matéria. Após verificada a versão
mais recentes dos diplomas legais pertinentes, resta compreender o processo e o
procedimento administrativos igualmente capazes de tornarem esse intento realidade
ou obstaculizarem tal jornada.
Defined as a legal and political bond between a State and a person, nationality presents, simultaneously, a vertical and a horizontal dimension. The vertical nationality consists in the establishment of reciprocal duties and rights between a country and its nationals. Meanwhile, the horizontal nationality is regarded as the feeling of belonging to cultural manifestations as well as being a part of the traditions and way of life associated with a specific State. In other words, this second type of manifestation of nationality is a symbol of the desire to effectively belong to the people of a State. Both types of nationality represent a proof of mutual loyalty between a country and its nationals. It is this special kind of loyalty that allows a State to choose its own criteria to grant such status. These will be different depending which point in an individual’s life it is obtained. Nationality which is granted to a foreigner who demonstrated the will to become a national of another State after his birth matches the hypothesis of acquisition of a derived nationality. In case of wanting to become a portuguese national by these means, one will need to comprehend the criteria chosen for that purpose according to portuguese law. These criteria are a product of historical development of the attempt to answer – throughout the centuries – the following question: who may become a portuguese national? The solution for this question is constantly adapted, as legal updates regarding this subject keep happening. Once verified the most recent versions of the law relevant to this matter, it is necessary to understand the administrative process and procedure since both are able to turn this wish into reality or to make this journey full of obstacles.
