Abstract
A presente dissertação de mestrado, intitulada “Uma análise sobre a efetivação do direito de ação popular no processo administrativo português – A autarquia local enquanto autora popular”, realizada no âmbito do mestrado em ciência jurídica forense, tem como objetivo principal um estudo pormenorizado sobre a ação popular, nomeadamente, a ação popular administrativa, como meio de tutela de interesses difusos, por um lado, e, por outro lado, discutir a legitimidade popular das autarquias locais.
Assim sendo, começaremos por analisar o direito à tutela jurisdicional efetiva, enquanto direito “mãe” do direito fundamental de acesso aos tribunais, nomeadamente, o direito de ação. O que nos obriga, de seguida, a analisar o instituto da ação popular, designadamente, o seu regime, incluindo os autores populares, os interesses tutelados, o papel do Ministério Público, o papel do Juiz, o caso julgado, o direito à indemnização e o regime especial de preparos, custas e procuradoria. Contudo, sendo o objeto do presente estudo, o processo administrativo português, é neste âmbito que nos cabe analisar tal instituto, designadamente, na ação administrativa principal não urgente e nas ações administrativas principais urgentes.
Sendo este um tema que tem suscitado alguns debates e posições, dedicaremos um subcapítulo a cada questão que gera controvérsia, onde serão discutidas algumas questões a que nos propomos responder com o presente trabalho, recorrendo, para tanto, à doutrina nacional e estrangeira e à jurisprudência.
Por último, dedicaremos a nossa atenção ao estudo do poder local, designadamente, aos princípios que lhe estão subjacentes, o que nos conduzirá à caracterização e análise do regime jurídico das autarquias locais. Tal enquadramento urge para nos debruçarmos sobre a questão principal do presente estudo, ou seja, a legitimidade popular das autarquias locais. Para o efeito, abordarmos as questões mais problemáticas que se levantam neste âmbito, lançando mão, de um estudo de caso, que nos ajudará a compreender melhor a importância prática de tais questões. Neste sentido, haverá lugar a uma tomada de posição quanto às problemáticas suscitadas, devidamente fundamentada, com o apoio doutrinal e jurisprudencial.
This master’s thesis, entitled “An analysis of the effectiveness of the right of popular action in the portuguese administrative process – The local authority as a popular author”, carried out as part of the master’s degree in forensic legal science, has as its main objective a detailed study of popular action, specifically administrative popular action, as a way of protecting the diffuse interests of the community, on the one hand, and, on the other, to discuss the popular legitimacy of local authorities. We will therefore begin by studying the right to effective judicial protection, as the “mother” right of the fundamental right of access to the courts, specifically the right of action. This obliges us to analyze the institute of popular action, especially its regime, including popular authors, the interests protected, the role of the Public Prosecutor’s Office, the role of the judge, res judicata, the right to compensation and the special regime of preparation, expenses and representation. However, since the object of this study is the administrative process, it is in this context that we must analyze this institute, specifically in non-urgent main administrative actions and urgent main administrative actions. As this is a subject that has given rise to a lot of debate and positions, we will dedicate a sub-chapter to each controversial issue, where we will discuss some of the questions we intend to answer, using national and foreign doctrine and case law. Finally, we will devote our attention to the study of local power, specifically the principles that support it, which leads us to look into the characterization of local authorities and the analysis of each one of them. This framework is essential if we are to address the main issue of this study, i.e. the popular legitimacy of local authorities. To this end, we will address the most problematic issues that arise in this area, using a case study, which will help us to better understand the practical importance of such issues. In this sense, a position will be taken on the issues raised, duly substantiated, with the support of doctrine and case law.
