Abstract
Pretende-se apresentar neste trabalho breve síntese do problema social do assédio
laboral, com a sua conceituação, formas de ocorrência e as preocupações do legislador
português e brasileiro para impedir a continuação dessa prática. Encontramos no
caminho da instituição de um programa de compliance uma possibilidade para a
adequação das empresas nas práticas corretas de evitar o problema social, na forma
de um regulamento interno da empresa. Para isso, falaremos dos pilares de um
programa de conformidade, as responsabilidades de um canal de denúncia e
comunicação e de um processo de investigação, apontando para a necessidade de um
código de ética mais claro e efetivo, com enfoque na ocorrência de situações de assédio
no ambiente de trabalho. Tem-se por objetivo apresentar a obrigação do empregador
de garantir e manter um ambiente de trabalho em elevado padrão de bem estar no
aspecto físico e emocional, devendo estabelecer, para tanto, políticas quanto aos
comportamentos aceitáveis, as medidas e punições em casos de desconformidade,
fortalecendo a cultura ética dentro da empresa, na preservação da sua imagem e
reputação e garantindo aos empregados, diretores e sócios um ambiente saudável.
It is intended to present in this work a brief synthesis of the social problem of workplace harassment, with its conceptualization, ways of occurrence and the concerns of the Portuguese and Brazilian legislators to prevent the continuation of this practice. We found in the path of the institution of a compliance program a possibility for companies to adapt themselves to the correct practices to avoid the social problem, in the form of the company's internal regulations. For this, we will talk about the pillars of a compliance program, the responsibilities of a reporting and communication channel and an investigation process, pointing to the need for a clearer and more effective code of ethics, focusing on the occurrence of harassment situations in the work environment. The objective is to present the employer's obligation to guarantee and maintain a work environment with a high standard of well-being in the physical and emotional aspect, and to establish, for this purpose, policies regarding acceptable behaviors, measures and punishments in cases of non-compliance. , strengthening the ethical culture within the company, preserving its image and reputation and ensuring a healthy environment for employees, directors and partners.
