Abstract
A presente pesquisa pretende realizar um estudo comparado sobre o bem de família no
Brasil e os mecanismos de proteção da Casa de Morada de família em Portugal. O objetivo da
presente pesquisa é cotejar os institutos de cada país, instituídos por sua legislação própria,
apontando semelhanças e diferenças entre ambos.
Para tanto será realizada a análise da constituição e evolução histórica dos institutos em
cada um dos países, buscando compreender qual a mens legis por trás da instituição deste bem
jurídico, bem como o apontamento e análise das normativas que o instituíram e que atualmente os
regulamentam, a legislação em que estão previstos, sendo ainda realizado um breve
levantamento bibliográfico a respeito das pesquisas já realizadas acerca destes institutos em
outras pesquisas já publicadas anteriormente, para, ao final observarmos ainda a jurisprudência
que os discute.
Justifica-se a relevância desta pesquisa em razão do bem de família no Brasil e os
mecanismos de proteção da Casa de Morada de família em Portugal constituírem-se em um
arcabouço protetivo da casa, ou morada, da família, visando proteger bens jurídicos maiores que
são o direito à dignidade da pessoa humana, o direito à moradia, o direito à moradia digna, e o
direito à segurança, no espectro de que deve ser o Estado o principal guardião destes bens
fundamentais.
Serão explicitados como resultado semelhanças com relação à fundamentação, finalidade,
para a existência de ambos direitos – o bem de família e a proteção da Casa de Morada de família
–, mas principalmente explicitadas as diferenças dos institutos brasileiro e português, no que diz
respeito ao escopo, aplicabilidade, valor, extensão e penhorabilidade/impenhorabilidade, enquanto
medidas protetivas do bem jurídico instituído.
The present research intends to carry out a comparative study on the family property in Brazil and the protection mechanism of the family home in Portugal. This research’s objective is to compare each country's institutes, instituted by their own legislation, which pointed out similarities and differences between them. Therefore, the constitution’s analysis and the institutes’ historical evolution, in each of the countries, will be carried out, seeking to understand what is the mens legis behind the legal asset of the institution, as well as the notes and analysis of the regulations that instituted it and that currently regulate them, the legislation in which they are foreseen, and also a brief bibliographical survey is carried out regarding to the researches already performed about these institutes in other researchers already published previously, so that, in the end, we can observe the jurisprudence that discusses them. This research’s relevance is justified due to the family property in Brazil and the change in the protection mechanism of the family home in Portugal constitute a protective framework for the family home, or residence, in order to protect greater legal interests that are the human dignity right, the housing right, the decent housing right, and the security right, in the spectrum that the State must be the main guardian of these fundamental goods. As a result, the similarities in relation to the rationale, purpose, for the existence of both rights – the family good and the protection of the family home – will be explained, but mainly the differences between the Brazilian’s and Portuguese’s institutes will be enlightened, regarding to the scope, applicability, value, extension and attachment/non-attachment, as protective measures of the instituted legal interest.
