O desempenho do extinto Tribunal da Função Pública da União Europeia e a defesa dos direitos.

Abstract

O Tribunal de Justiça da União Europeia (TJUE) é uma das instituições comunitárias originárias, que realizou, ao longo de mais de 60 anos, uma contribuição essencial ao êxito da integração europeia tal como a conhecemos hoje em dia. Esta instituição é constituída por mais do que uma jurisdição: o Tribunal de Justiça (TJ), o Tribunal Geral (TG) e a possibilidade de criação de câmaras jurisdicionais específicas com competência para conhecer certas categorias de litígios, nos termos do artigo 19.º do Tratado da União Europeia, de onde resultou o Tribunal da Função Pública da União Europeia. A recente transferência, em 2016, por regulamento, para o TG da competência para decidir, em primeira instância, dos litígios entre a União Europeia e os seus agentes, resulta como a consequência da extinção do Tribunal da Função Pública, a funcionar desde 2005. Pretende-se, com este acontecimento ainda recente, abordar o papel desenvolvido pelo TFP nestes seus cerca de dez anos de atividade, com referência aos documentos-chave do seu percurso, por referência ao jornal oficial da União Europeia e com menção ao papel das jurisdições comunitárias na defesa dos direitos fundamentais, não esquecendo a reforma institucional de aumento faseado do número de juízes da União. The Court of Justice of the European Union (CJEU) is one of the Community originating institutions that held over more than 60 years, an essential contribution to the success of European integration as we know it today. This institution consists of more than one jurisdiction: the Court of Justice (ECJ), the General Court (GC) and the possibility of establishing specific judicial panels with jurisdiction to hear certain categories of disputes, in accordance with article 19 of the EU Treaty, which resulted in the European Union Civil Service Tribunal. The recent transfer, in 2016, by regulation, to the GC of the power to decide in the first instance in disputes between the European Union and its agents, results such as the eradication of the Civil Service Tribunal, operating since 2005. It is intended, with this still recent event, address the role played by CST in these its approximately ten years of activity, with reference to the key documents of the journey, by reference to the Official Journal of the European Union and with mention of the role of courts Community in defense of fundamental rights, not forgetting the institutional reform phased increase in the number of EU judges.
