Abstract
A presente dissertação tem como objeto de estudo a aplicabilidade do princípio da Eficiência
como instrumento de controle da concessão de serviços públicos ao setor privado. A
crescente exigibilidade de melhoria na prestação de serviços essenciais, instituída durante as
reformas da Administração Pública, deu início ao processo de descentralização das
atividades desempenhadas pelo Estado. A justificativa se fundamentava na busca pela
garantia da eficiência da máquina estatal, elevando esta qualidade a princípio constitucional
norteador do ato administrativo na defesa dos interesses e do bem-estar da coletividade.
Todavia, enquanto princípio jurídico, a eficiência tem pouca densidade normativa, revelando
a necessidade de um estreito vínculo com os demais princípios fundamentais da
Administração Pública, para a sua aplicação e controle. O resgate do modelo de concessão
de serviços públicos possibilitou a utilização dos recursos estratégicos da iniciativa privada
no exercício das atividades estatais, promovendo, a priori, maior eficiência na prestação dos
serviços. Contudo, a maioria dos problemas decorrentes do modelo patrimonialista e
burocrático persistiu, dando continuidade às insatisfações populares. Tal configuração
ensejou a criação das Agências Reguladoras, entidades incumbidas de regular a relação
contratual de concessão, de forma independente e imune às interferências de agentes
externos e dos próprios órgãos da Administração Pública direta. Para garantir a plena
eficiência da atuação regulatória, foram criados mecanismos de controle da própria Agência,
os quais visam a resguardar a sua autonomia decisória, de objetivos, de instrumentos e
financeira em prol do interesse público.
The purpose of this dissertation is to study the applicability of the Efficiency Principle as an instrument to control the concession of public services to the private sector. The increasing demand for improvement in the provision of essential services - instituted during the reforms of the Public Administration - triggered the process of decentralization of the activities carried out by the State. Its justification was based on the search for the guarantee of the efficiency of the State machinery, raising its quality to the constitutional principle guiding the Administrative Act in defense of the interests and well-being of the collectivity. Nevertheless, efficiency - as a legal principle - has little normative density, revealing the need for a close link with the other fundamental principles of Public Administration, as well as for their application and control. The rescue of the concession of public services model made the use of the strategic resources of the private initiative in the exercise of state activities possible, promoting a priori, greater efficiency in the rendering of services. Yet, most of the problems stemming from the patrimonialist and bureaucratic model persisted, keeping popular dissatisfaction ongoing. This configuration led to the creation of Regulatory Agencies - entities responsible for regulating the contractual relationship of concession, independently and immune to the interference of external agents as well as the organs of direct Public Administration. In order to ensure the full efficiency of regulatory action, control mechanisms have been created by the Agency itself, which aim at safeguarding its decision-making autonomy, objectives, instruments and finances on behalf of the public interest.
