Abstract
A presente pesquisa refere-se a análise da jurisprudência como método de investigação científica, visando descobrir a aplicação do instituto do dever de mitigar o próprio prejuízo no Direito brasileiro e português. Este princípio decorre da boa-fé objetiva e permite conferir maior segurança jurídica nas relações contratuais e extracontratuais, por impor uma atuação por parte do lesado que diminua os danos causados por outrem, quando possível. A pesquisa perpassou por análise bibliográfica e jurisprudencial e utilizou os métodos misto e comparado, sendo coletados dados dos sítios das Cortes Brasileiras – STJ/BR e TJRJ - e portuguesas – STJ/PT, TRP, TRC, TRG e TRL-, com o fito de comparar a frequência com que a citada teoria foi utilizada por cada país e a forma como influenciou o resultado da decisão. Em suma, o dever de mitigar os próprios prejuízos se mostrou aplicável em casos de diversas naturezas jurídicas, v.g., bancárias, aluguel imobiliário, seguro, entre outras relações extracontratuais.
The present research refers to the analysis of jurisprudence as a scientific research method, aiming to discover the application of the institute of the duty to mitigate the loss in Brazilian and Portuguese Law. This principle derives from objective good faith and allows for greater legal certainty in contractual and extra-contractual relations, by imposing an action on the part of the injured party that reduces the damage caused by others, when possible. The research included a bibliographic and jurisprudential analysis and used the mixed and comparative methods, collecting data from the websites of the Brazilian Courts - STJ/BR and TJRJ - and the Portuguese Courts - STJ/PT, TRP, TRC, TRG and TRL-, in order to compare the frequency with which the aforementioned theory was used by each country and how it influenced the outcome of the decision. In short, the duty to mitigate one's own losses has proven applicable in cases of various legal natures, v.g., banking, real estate rentals, insurance, among other non-contractual relations.
