Os efeitos processuais da sentença declaratória de insolvência em face do direito positivo português

Abstract
Esta investigação visa encontrar respostas à indagação sobre os efeitos processuais
decorrentes da sentença declaratória de insolvência à luz da legislação portuguesa. A
metodologia contempla um estudo bibliográfico, com descrição e análise ancoradas na
legislação e em fontes bibliográficas que possibilitam visões e interpretações sobre a
insolvência e a recuperação de empresas. São trazidos elementos da evolução histórica
do direito falimentar para compreender os institutos jurídicos da insolvência que se
encontram positivados no Código da Insolvência e da Recuperação de Empresas
(CIRE). Na análise legal do artigo 85º observa-se a necessidade de se apensar ao
processo de insolvência as ações que possam influenciar no patrimônio da massa
insolvente e os processos à época existentes nos quais se constate a existência de ato
de apreensão ou detenção, tendo como objeto bens da massa insolvente. Conforme o
artigo 86º, os efeitos processuais investigados determinam a apensação entre
processos de insolvência com declaração da insolvência de pessoas que respondam do
ponto de vista legal pelas dívidas do insolvente. Dispensa-se uma atenção mais
detalhada ao fato de tais efeitos também atingirem as sociedades que se encontram em
relação de grupo. Na continuidade chama-se à baila os termos do artigo 87º, que
disciplina pela obrigação de suspensão e eficácia das convenções arbitrais do devedor
insolvente assim declarado judicialmente, devendo, neste caso, serem observados
tratados internacionais dos quais Portugal é signatário. Os efeitos processuais também
repercutem nas ações executivas em curso contra o devedor insolvente, sendo que
aquelas são suspensas em face de que todos os direitos sobre a massa falida deverão
ser reclamados no processo de insolvência na estrita observância do referido Código.
Isto em face da par conditio creditorum que prima pela igualdade entre os credores,
observadas as regras do Decreto-Lei nº 53/2004. Por último, com base no artigo 89º são
analisados os efeitos processuais estudados em face de possíveis ações relativas a
dívidas da massa insolvente. In casu a obrigatoriedade de tais processos serem
dirigidos a um juiz falimentar com a apensação ao processo de insolvência em tramite.
This investigation aims to find answers to the question about the procedural effects arising from the declaratory sentence of insolvency under Portuguese law. The methodology includes a bibliographical study, with description and analysis anchored in the legislation and in bibliographic sources that allow visions and interpretations about the insolvency and the recovery of companies. Elements of the historical evolution of bankruptcy law are brought to understand the legal institutes of insolvency that are established in the Insolvency and Corporate Recovery Code (CIRE). In the legal analysis of article 85, there is a need to attach to the insolvency process the actions that may influence the assets of the insolvent estate and the processes existing at the time in which the existence of an act of apprehension or detention is found, having as object assets of the insolvent estate. Pursuant to article 86, the procedural effects investigated determine the joining of insolvency proceedings with declaration of insolvency of persons who are legally liable for the insolvent's debts. More detailed attention is needed to the fact that such effects also affect societies that are in a group relationship. Next, the terms of article 87, which regulate the suspension and effectiveness of the arbitration agreements of the insolvent debtor so declared in court, are called up, in which case international treaties to which Portugal is a signatory must be observed. The procedural effects also affect the ongoing executive actions against the insolvent debtor, which are suspended given that all rights over the bankrupt estate must be claimed in the insolvency process in strict compliance with the aforementioned Code. This is due to the par conditio creditorum that strives for equality between creditors, subject to the rules of Decree-Law No. 53/2004. Finally, based on Article 89, the procedural effects studied in the face of possible actions related to the insolvent estate's debts are analyzed. In casu the obligation of such processes to be directed to a bankruptcy judge with the attachment to the insolvency process in progress.
