No final do século XIX, o Brasil Império passava a ser uma República. A Igreja
Católica, até então grande responsável pelos registos dos nascimentos, casamentos e
óbitos, perdera essa atribuição, porque o registo civil tornou-se obrigatório. Nesse intervalo
de tempo, milhões de cidadãos europeus chegavam ao Brasil. Entre esses, os mais
numerosos foram os italianos e os portugueses. Atualmente, observa-se um incremento
pela busca da nacionalidade italiana ou portuguesa pelos descendentes brasileiros desses
europeus. À vista da falta do registo civil de casamento religioso realizado nessa época, os
descendentes têm buscado no judiciário brasileiro uma alternativa: pleiteiam o registo civil
tardio post mortem do casamento. Contudo, diferente da lei portuguesa, a lei brasileira não
prevê a possibilidade de registo civil tardio de casamento religioso, após o falecimento do
casal. Assim, diante dessa lacuna, mas invocando-se o conhecimento histórico-cultural, a
posse do estado de casados e a comparação com a lei portuguesa, indaga-se, pelo método
hipotético-dedutivo, sobre a solução mais correta para tal pedido.
At the end of the 19th century, the Brazilian Empire became a Republic. The Catholic Church, that was largely responsible for the registration of births, marriages and deaths, lost that attribution because civil registration became mandatory. In the interim, millions of European citizens arrived in Brazil. Among these immigrants, the most numerous were the Italians and the Portuguese. Today, there is an increase in the search for Italian or Portuguese nationality by the Brazilian descendants of these European citizens. A marriage certificate from the end of the 19th century and the beginning of the 20th century can be used in the nationality process and is often required. In view of the lack of civil registration of religious marriages celebrated at that time, descendants have sought an alternative in the Brazilian court system: requesting late civil registration of the catholic marriage. However, unlike Portuguese law, Brazilian law does not allow the late civil registration of religious marriage after the couple's death. Thus, due to this gap, yet relying on the historical-cultural knowledge, the possession of the state of marriage and the comparison with Portuguese law, the most correct solution for such a request is examined by the hypothetical-deductive method.
