Abstract
A história das mulheres é marcada por desigualdades em relação aos homens.
Apoiados em princípios morais, culturais e religiosos, os homens as agrediram. As
mortes, agressões, privações de direitos propulsionaram a busca por uma legislação
que considerasse a igualdade e a dignidade da pessoa humana.
Sob essa égide, buscando melhor proteção aos direitos humanos, foi editada a
Lei 11.340/06, garante constitucional em sentido amplo. Esse tema provocou
discussões no meio jurídico quanto ao tipo de ação penal aplicada aos autores de
casos de lesão corporal relacionados com a violência doméstica e familiar e quanto ao
facto da ação penal ser considerada pública incondicionada à representação, o que
teria tirado o poder de decisão das mulheres por tantos séculos negado, colocando-as
novamente em condição de submissão.
O objetivo geral desta pesquisa consiste em investigar o fenômeno da violência
doméstica e familiar e se a natureza da ação penal pública incondicionada à
representação atende a vontade/necessidade de proteção das vítimas.
Metodologicamente, foi realizada pesquisa bibliográfica e entrevistas
semiestruturadas, suscitando o debate acadêmico. Obteve-se como resultado: a ação
penal está de acordo com a vontade das vítimas. Com base nas análises, conclui-se
que a ação pública incondicionada garante maior proteção às vítimas.
The history of women is marked by inequalities in relation to men. Supported by moral, cultural and religious principles, men attacked them. Deaths, aggressions, deprivation of rights propelled the search for legislation that considered the equality and dignity of the human person. Under this aegis, seeking better protection of human rights, Law 11,340/06 was edited, with a broad constitutional guarantee spectrum. This issue provoked discussions in the legal environment regarding the type of criminal action applied to the authors of cases of bodily injury related to domestic and family violence and regarding the fact that the criminal action is considered public unconditioned to representation, which would have taken away the power of decision of women denied for so many centuries, putting them again in a condition of submission. The overall objective of this research is to investigate the phenomenon of domestic and family violence and whether the nature of public criminal action unconditioned to representation meets the will/need for victim’s protection. Bibliographic research and semi-structured interviews were carried out methodologically, raising academic debate. Obtained results were: the criminal action is in accordance with the will of the victims. Based on the analyses, it is concluded that unconditional public action guarantees greater protection for victims.
