Abstract
A presente dissertação se propõe a classificar o direito humano de acesso à justiça
como Direito de 2ª Geração, uma vez que trata de direito social de abrangência
coletiva, considerando-o como o mais importante, pois é por meio dele que se garante
a preservação de todos os demais direitos.
Sua definição ultrapassa o conceito de acesso aos tribunais, transpondo a
isenção/dispensa do pagamento de custas processuais, perpassando pelo conceito do
processo justo e justa decisão, além da duração razoável do processo.
O benefício da Justiça Gratuita e do Apoio Judiciário não podem ser considerados
como responsáveis pelos abusos do direito de ação, seja através da litigância frívola
ou do beneficiário crônico, devendo a responsabilidade pelos desvios ser atribuída às
partes litigantes, ou até mesmo aos advogados, defendendo-se uma punição severa
quando houver a constatação do abuso.
Proferida a decisão no processo, caso a parte discorde ou esteja em desacordo com o
entendimento jurisprudencial, é cabível sua impugnação através do duplo grau de
jurisdição, instrumentalizado pelo recurso, que em conjunto com seus requisitos e
admissibilidade dos recursos são essenciais para o acesso efetivo à justiça.
The present dissertation proposes to classify the human right of access to justice as a 2nd Generation Right, since it deals with a collective social right, considering it as the most important, as it is through it that the preservation of all other rights. Its definition goes beyond the concept of access to the courts, transposing the exemption / waiver of payment of procedural costs, going through the concept of fair process and fair decision, in addition to the reasonable duration of the process. The benefit of Free Justice and Legal Aid cannot be considered as responsible for the abuse of the right of action, either through frivolous litigation or the chronic beneficiary, and the responsibility for deviations should be attributed to the litigating parties, or even to the lawyers, defending severe punishment becomes apparent when abuse is found. Once the decision is rendered in the case, if the party disagrees or disagrees with the jurisprudential understanding, it is possible to challenge it through the double degree of jurisdiction, instrumentalized by the appeal, which together with its requirements and admissibility of the appeals are essential for effective access the Justice.
