Inviabilidades do sistema judicial angolano

Abstract

No âmbito do Direito Constitucional Angolano, apresentamos alguns pontos de atuação do Presidente da República que vão de encontro com a nossa investigação e torna, ao nosso ver, o sistema judicial inviável, ao ser uma máquina estatal completamente dependente à sua pessoa, ainda que numa primeira perspetiva seja uma dependência moral. No disposto das alíneas e) a h), e t) do artigo 119.º da Constituição da República de Angola, constatamos uma interferência das funções executivas e judiciais, dentro do princípio da separação dos Poderes, normativo que é a base da nossa investigação. A caracterização do sistema judicial angolano com base nas funções do Presidente da República, a bagagem histórica da Constituição da República Angolana em comparação com os países vizinhos, o poder da Constituição na ordem social e no desenvolvimento socioeconómico da nação, e as perspetivas futuras que o sistema judicial angolano deveria seguir, são elementos que constam desta investigação. A ideia de como deveria funcionar o sistema judicial angolano para a academia e para a sociedade em geral é um dos pontos desta investigação, ao qual se recomenta a revisão parcial da Constituição da República Angolana, relativamente aos poderes do Presidente da República aquando da nomeação de juízes dos Tribunais superiores, por esta ser uma faculdade desfasada do critério do Estado de Direito democrático.

Within the scope of Angolan Constitutional law, we present some points of action of the President of the Republic that meet with our investigation and are the cause the unfeasibility of the judicial system, as it makes the State entirely dependent on him, even if it seems at first as a moral dependency. In the provisions of paragraphs e) to h) and t) of article 119. ºof the Constitution of the Republic of Angola, we acknowledge the interference of the executive and judicial functions, within the principle of the separation of powers, one of the key points of our investigation. The characterization of the Angolan judicial is system based on the roles of the President of the Republic and the historical background of the Constitution of the Republic of Angola, in comparison with neighbouring countries. The strength of the constitution in the social order and socio-economic development of the nation and the future prospects that the Angolan judicial system should pursue are key elements of this investigation. The opinion on how the Angolan judicial system should work for academia and society in general is another of the key points on our investigation, in which we recommend the partial revision of the Constitution, regarding the roles and powers of the President of the Republic to appoint high court judges, a faculty off-limits within the democratic rule of law.
