Abstract
A presente Dissertação objetiva o estudo crítico acerca das Varas da Fazenda Pública existentes na capital do Estado do Maranhão, notadamente as 6ª e 7ª Varas Fazendárias, instaladas no mês de setembro de 2017. Tem como proprósito evidenciar a real necessidade de instalação destas, haja vista a elevada quantidade de demandas/processos em desfavor do Estado do Maranhão e respectivos Muncípios para essas distribuídas. Visa, dentre outras, destacar as particularidades facultadas às Varas da Fazenda Pública, tais como as hipóteses de concessão de tutela provisória vedadas por lei, prazos processuais e formas de intimação e citação. Tem como propósito, inclusive, destacar quais os tipos de ações que são distribuídas para as Varas em destaque, e ainda, identificar quais as razões para o elevado número de demandas propostas judicialmente, bem como trazer à tona um estudo comparativo entre Brasil e Portugal no que atine aos meios alternativos para solução de conflitos e o tratamento dado por estes quando dos tipos de ações propostas corriqueiramente. Ademais, o trabalho propõe identificar quais são as hipóteses em que determinadas demandas podem ser declinadas das Varas Fazendárias para os Juizados Especiais das Varas da Fazenda Pública. Tem como fito salientar as possibilidades de concessão de gratuidade de justiça quando da proposição de eventual demanda e as situações em que se concedem liminares quando a Fazenda Pública constar em determinada lide. Objetiva comparar as vantagens e desvantagens entre os Processos Físicos e os Processos Eletrônicos, assim como o prazo prescricional definido por lei para ajuizar qualquer demanda em desfavor das Varas da Fazenda Pública. Pesquisas bibliográficas e consolidação documental formam o procedimento adotado para a realização do trabalho, os quais convergem para a necessidade de mão de obra no Judiciário maranhense, com o fito de atender às necessidades dos jurisdicionados.
This Dissertation aims at the critical study about the Public Finance Courts existing in the capital of the State of Maranhão, notably the 6th and 7th Farm Courts, installed in the month of September 2017. Its purpose is to highlight the real need to install these, considering the high number of demands / lawsuits against the State of Maranhão and the respective Municipalities for those distributed. It aims, among others, to highlight the particulars provided to the Public Finance Courts, such as the hypotheses for granting provisional protection prohibited by law, procedural deadlines and forms of subpoena and summons. It also has the purpose of highlighting the types of actions that are distributed to the Highlights, and also to identify the reasons for the high number of lawsuits proposed, as well as to bring up a comparative study between Brazil and Portugal in the that addresses alternative means for resolving conflicts and the treatment given by them when the types of actions proposed are routinely used. In addition, the work proposes to identify which are the hypotheses in which certain demands can be declined from the Farmer Courts to the Special Courts of the Public Finance Courts. Its purpose is to highlight the possibilities of granting free justice when proposing an eventual demand and the situations in which injunctions are granted when the Public Finance is included in a specific dispute. It aims to compare the advantages and disadvantages between Physical Processes and Electronic Processes, as well as the statutory statute of limitations for filing any claim against the Public Finance Courts. Bibliographic research and documentary consolidation form the procedure adopted for carrying out the work, which converge to the need for manpower in the Maranhão Judiciary, with a view to meeting the needs of the jurisdicted.
