O papel do Sistema Judiciário angolano enquanto garante da proteção dos Direitos Humanos

Abstract

A presente dissertação analisa o papel do sistema judiciário angolano na proteção e promoção dos Direitos Humanos, tendo como base a Constituição da República de Angola e os compromissos internacionais assumidos pelo Estado. O estudo parte da consagração constitucional dos direitos fundamentais e examina a forma como os Tribunais, o Ministério Público e as instituições da Justiça atuam como pilares do Estado de Direito e garantes da dignidade da pessoa humana. Num primeiro plano, procede-se ao enquadramento jurídico e institucional da tutela dos Direitos Humanos em Angola, destacando a articulação entre normas internas e obrigações internacionais. Em seguida, são analisados os principais obstáculos à efetivação dos direitos, incluindo limitações estruturais do sistema judicial, dificuldades no acesso à justiça, fatores culturais e sociais e desafios relacionados com a independência e eficiência das instituições. A investigação aborda ainda casos emblemáticos de alegadas violações de direitos fundamentais, com particular atenção nas garantias do devido processo legal, na liberdade de expressão e na atuação das forças de segurança, bem como o papel das Organizações da Sociedade Civil na monitorização e denúncia de abusos. Conclui-se que, apesar dos avanços normativos, a efetiva proteção dos Direitos Humanos em Angola depende do fortalecimento contínuo da Justiça, da formação dos seus profissionais e da consolidação de uma cultura cívica orientada para a dignidade humana.

This dissertation analyses the role of the Angolan judicial system in the protection and promotion of Human Rights, based on the Constitution of the Republic of Angola and the international commitments undertaken by the State. The study begins with the constitutional recognition of fundamental rights and examines how the courts, the Public Prosecutor’s Office, and justice institutions function as pillars of the rule of law and guarantors of human dignity. At a first level, the research provides a legal and institutional framework for the protection of Human Rights in Angola, highlighting the interaction between domestic norms and international obligations. It then explores the main obstacles to the effective realization of rights, including structural limitations of the judicial system, barriers to access to justice, cultural and social factors, and challenges related to the independence and efficiency of institutions. This investigation also examines emblematic cases of alleged violations of fundamental rights, with particular attention to due process guarantees, freedom of expression, and the conduct of security forces, as well as the role of civil society organizations in monitoring and reporting abuses. It concludes that, despite normative progress, the effective protection of Human Rights in Angola depends on the continuous strengthening of the justice system, the training of its professionals, and the consolidation of a civic culture oriented toward human dignity.
