Abstract
A pesquisa está centrada no estudo acerca das Leis de exceção aplicadas no Brasil e em Portugal durante o período pandêmico e a segurança dos nacionais em detrimento da urgência da contenção do vírus Sars Covid 19, determinada pela Organização Mundial da Saúde (OMS). Objetiva-se investigar e analisar o impacto das Leis de exceções adotadas pelo Governo Brasileiro e os Estados por meio das relações políticas e econômicas e a aplicabilidade dos Direitos Humanos em comparação com o modelo adotado em Portugal contribuindo na forma como os Direitos Humanos se constituem num estado de exceção. É um estudo comparativo, com metodologia adotada em duas técnicas de pesquisa: a bibliográfica e a documental. Como resultados obtidos, foi possível verificar que o mundo não estava preparado para o evento pandêmico que assolou o planeta, mas com consciência e humanidade, certamente, os governos que assim procederam puderam cuidar melhor da população. Brasil e Portugal tiveram fortes diferenças nesse sentido, mas o que os deixou ainda mais distantes quanto às formas de reação foi a compreensão da real letalidade do vírus.
The research is centered on the study of the exception laws applied in Brazil and Portugal during the pandemic period and the safety of nationals to the detriment of the urgency of containing the Sars Covid 19 virus, determined by the World Health Organization (WHO). The objective is to investigate and analyze the impact of the Laws of exceptions adopted by the Brazilian Government and the States through political and economic relations and the applicability of human rights in comparison with the model adopted in Portugal, contributing to the way in which human rights are constituted in a exception status. It is a comparative study, with methodology adopted in two research techniques: bibliographical and documental. As results obtained, it was possible to verify that the world was not prepared for the pandemic event that devastated the planet, but with conscience and humanity, certainly, the governments that proceeded in this way were able to take better care of the population. Brazil and Portugal had strong differences in this regard, but what made them even more distant in terms of reaction was the understanding of the real lethality of the virus.
