| dc.description.abstract | Como forma de progressão na carreira e componente essencial para o funcionamento da estrutura militar, as promoções, devem ser motivadas. O controle judicial e administrativo sobre as promoções por merecimento no âmbito das forças militares, leva a uma reflexão sobre esta necessidade de motivar as escolhas feitas pelos gestores no momento das promoções, pois hoje, a prática de atos administrativos, sem qualquer fundamentação e sob o manto da discricionariedade, tem provocado uma corrida não só ao Poder Judiciário como também, ao Conselho de Estado. Sendo assim, o objetivo do presente trabalho foi voltado para análise do critério promoção por merecimento e quais motivos tem levado a judicialização deste tema e como o Poder Judiciário e o Conselho de Estado tem enfrentado este assunto. O método de pesquisa utilizado foi o da revisão bibliográfica, sendo a pesquisa do tipo exploratória-descritiva, caracterizando-se como qualitativa. Concluiu-se que o gestor, seja ele chefe do Executivo Estadual ou Comandante Geral, em clara obediência ao princípio da motivação, deve apontar, de forma objetiva, as qualidades e mérito que os fizeram optar por um oficial em detrimento dos demais. Atitudes como esta diminuiriam, ou até extirpariam, com demandas judiciais e administrativas em torno das promoções por merecimento. | pt_PT |
| dc.description.abstract | As a way to advance in one's career and as an essential component for the functioning of the military structure, promotions must be motivated. The legal and managerial control over promotions by merit within the military leads to a reflection on the need to motivate the choices made by managers at the time of promotions, because today, the practice of administrative acts, without any justification and under the mantle of discretionary power, has caused a rush not only to the Judiciary but also to the State Council. This being the case, the objective of the following paper was aimed at analyzing the merit promotion criteria and the reasons that have led to the judicialization of this theme and how the Judiciary and the Council of State have faced this issue. The study method used was literature review, and the study was of the exploratory/descriptive and qualified type. It can be concluded that the manager, be it the head of the Executive State or the Chief- General Commander, in obvious conformity with the motivational principle, has to objectively point out the attributes and qualities that made them choose an Officer in opposition to the others. Such attitudes would reduce, if not eliminate, legal and institutional claims about promotions based on merits. | pt_PT |
