| dc.description.abstract | O presente estudo objetiva discutir as políticas públicas direcionadas à efetivação dos direitos humanos e sociais dos idosos. Para tanto, aborda a dignidade da pessoa humana e os fatores que determinam a responsabilidade internacional ante à violação aos direitos dos humanos; discute os direitos fundamentais do cidadão idoso e, mais notadamente os principais direitos sociais da população idosa; analisa o Estatuto do Idoso (EI), legislação que assegura amplos direitos à população idosa no Brasil; aborda os direitos dos pais idosos e os efeitos do abandono afetivo sobre a população idosa; expõe os maiores riscos e dificuldades suportados pelos idosos em uma sociedade desrespeitosa, a exemplo da violência intrafamiliar, dificuldade de locomoção, vulnerabilidade decorrente da falta de acesso à informação adequada e a dificuldade de acesso ao direito à saúde e prevenção de doenças; e esclarece sobre os deveres do Estado para com a população idosa, refletindo sobre a crescente judicialização dos direitos dos idosos e, neste contexto, sobre a importância do Ministério Público na efetivação desses direitos. Ressalte-se, por fim, que o panorama geral acerca do processo de envelhecimento e as medidas de proteção social direcionadas a atender às demandas da população que envelhece foi, nesta dissertação, constituído a partir do diálogo com a realidade brasileira e portuguesa, tomando-se por base a análise da bibliografia já produzida pertinente a essa temática e a consulta a fontes documentais, a exemplo da análise de legislações, conferência e estatísticas oficiais. | pt_PT |
| dc.description.abstract | The present study aims to discuss public policies aimed at the realization of the human and social rights of the elderly. To this end, it addresses the dignity of the human person and the factors that determine international responsibility in the face of violations of human rights; discusses the fundamental rights of the elderly citizen and, more notably, the main social rights of the elderly population; analyzes the Elderly Statute (EI), legislation that ensures broad rights to the elderly population in Brazil; addresses the rights of elderly parents and the effects of affective abandonment on the elderly population; exposes the greatest risks and difficulties faced by the elderly in a disrespectful society, such as intrafamily violence, mobility difficulties, vulnerability resulting from lack of access to adequate information and the difficulty of accessing the right to health and disease prevention; and clarifies the State's duties towards the elderly population, reflecting on the increasing judicialization of the rights of the elderly and, in this context, on the importance of the Public Ministry in the realization of these rights. Finally, it should be noted that the general panorama about the aging process and the social protection measures aimed at meeting the demands of the aging population was, in this dissertation, constituted from the dialogue with the Brazilian and Portuguese reality, taking into account based on the analysis of the bibliography already produced pertinent to this theme and the consultation of documentary sources, such as the analysis of legislation, conference and official statistics. | pt_PT |
