Abstract
Partindo da mudança de paradigma dos Direitos Humanos ao longo do séc.
XXI, a lei internacional, a educação, as efetivas necessidades e os procedimentos
inerentes, urge que se interpretem as razões de uma “nova” perspetiva de humanidade,
a “construção social e o contexto diversificado da transposição legal que condiciona a
vivência dos seres humanos e cidadãos, um pouco por todo o mundo e na União
Europeia em particular. Os ataques terroristas e as medidas de segurança
internacionais extremas; a proliferação da ideologia antissemítica, o racismo e as
estatísticas “perigosa” de discriminação; as “novas vagas” de Refugiados; a crise
económica que conduziu milhões de cidadãos à pobreza; a ausência de capacidade
para compreender e (re)agir em conformidade com as necessidades identificadas, face
à violência e à violação dos Direitos Humanos, têm sido as mais importantes causas de
mudança do paradigma e que têm fundamentado a presente pesquisa. A União
Europeia enfrenta estes problemas e mudanças no que concerne à proteção legal dos
Direitos Humanos apesar das mais distintas dificuldades. No entanto, um pouco por todo
o mundo, esta oposição entre a legalidade e as efetivas necessidades que deveriam ser
a prioridade de ação dos “poderes” não têm sido objetivos na promoção da proteção e
da Educação adentro dos Direitos Fundamentais da EU.
Starting from the paradigm shift of Human Rights throughout the century XXI, international law, education, the actual needs and the inherent procedures, urge to interpret the reasons for a “new” perspective of humanity, the “social construction and the diverse context of the legal transposition that conditions the experience of human beings and citizens, all over the world, and in the European Union in particular. Terrorist attacks and extreme international security measures; the proliferation of anti-Semitic ideology, racism and “dangerous” statistics of discrimination; the “new vacancies” of Refugees; the economic crisis that drove millions of citizens into poverty; the lack of ability to understand and (re) act in accordance with the identified needs, in the face of violence and the violation of Human Rights, have been the most important causes of paradigm shift and which have been the basis of the present research. The European Union faces these problems and changes regarding the legal protection of human rights despite the most distinct difficulties. However, around the world, this opposition between legality and the actual needs that should be the priority of action by the “powers” has not been objective in promoting the protection and education within the EU's Fundamental Rights.
