Abstract
Com a presente dissertação, intitulada “Violência Doméstica: problemáticas e
análise jurisprudencial” pretendemos que os seus leitores compreendam a posição de
especial fragilidade da vítima de violência doméstica, bem como a falha na atual
aplicação da legislação face à eficiente proteção da mesma.
Para que fosse possível uma maior compreensão desta temática, foi necessário,
em primeiro plano, começar por uma contextualização histórica, onde analisamos a
evolução legislativa que moldou o cenário legal e social em torno da violência doméstica.
O cerne do estudo reside na análise aprofundada do crime de violência doméstica,
abordando o bem jurídico em foco e examinando a exigência de reiteração e critérios
distintivos para sua caracterização.
O estatuto das vítimas no processo penal é um aspeto crítico explorado,
delineando distinções entre diferentes categorias e destacando a vulnerabilidade
especialmente acentuada das vítimas em casos de violência doméstica. A prevenção
da vitimização secundária, visando a justiça restaurativa, é também considerada.
Um olhar detalhado é lançado sobre as declarações para memória futura,
abordando o seu papel no crime de violência doméstica e examinando problemáticas
jurisprudenciais. Questões abordadas incluem a aplicabilidade do artigo 33.º, n.º 1 da
Lei 112/2009, o estatuto da vítima especialmente vulnerável e a admissibilidade das
declarações para memória futura, bem como a dispensabilidade da prestação de
depoimento em audiência de julgamento.
Finalmente, a questão do silêncio é explorada, com uma ênfase particular na
perspetiva da testemunha-vítima de violência doméstica e na valoração das declarações
prestadas por essa categoria específica de indivíduos.
Neste trabalho, emerge uma análise abrangente e rigorosa que aborda os
múltiplos ângulos e problemáticas relacionadas à violência doméstica, enriquecida por
uma análise aprofundada da jurisprudência envolvida. Cada tópico se entrelaça para
proporcionar uma visão holística das complexidades inerentes a essa área do direito e
às dinâmicas sociais associadas.
With this dissertation, titled "Domestic Violence: Issues and Jurisprudential Analysis," we aim for its readers to comprehend the particularly vulnerable position of domestic violence victims, as well as the shortcomings in the current application of legislation in effectively protecting them. In order to achieve a deeper understanding of this subject, it was essential to begin with a historical context. Here, we analyze the legislative evolution that shaped the legal and social landscape surrounding domestic violence. The core of the study lies in the in-depth analysis of the crime of domestic violence. This involves addressing the focused legal interest and examining the requirement for recurrence and distinctive criteria for its characterization. The status of victims within the criminal process is a critical aspect explored, delineating distinctions among different categories and emphasizing the heightened vulnerability of victims in cases of domestic violence. The prevention of secondary victimization, with a focus on restorative justice, is also considered. A detailed examination is conducted on statements for future reference, addressing their role in domestic violence cases and scrutinizing jurisprudential issues. Matters addressed encompass the applicability of Article 33(1) of Law 112/2009, the status of the victim as especially vulnerable, the admissibility of statements for future reference, and the dispensability of providing testimony during trial hearings. Finally, the issue of silence is explored, with particular emphasis on the perspective of witness-victims of domestic violence and the assessment of statements given by this specific category of individuals. This work presents a comprehensive and rigorous analysis that delves into the various angles and issues related to domestic violence. Enhanced by an in-depth analysis of the associated jurisprudence, each topic interweaves to provide a holistic view of the inherent complexities within this area of law and its associated social dynamics.
