A obsolescência do contrato de casamento

Abstract

Este trabalho analisa a crescente obsolescência do contrato de casamento, centrando-se no âmbito do direito português e destacando a sua rigidez, falta de transparência e incompatibilidades com os princípios contratuais civis contemporâneos. A pretensão será demonstrar que os nubentes frequentemente desconhecem os efeitos jurídicos do casamento, o que culmina na existência de vícios do consentimento, vícios esses que acabam por contribuir para o acentuar da litigiosidade em caso de rutura. A investigação inicia-se através de um acompanhamento da evolução histórica do instituto casamento, onde se verificam vários vícios da vontade aquando das primeiras manifestações do casamento formal. De seguida, é feita uma crítica à sua estrutura, pouco flexível, mesmo após as várias alterações sofridas ao longo dos anos. Finalmente, é discutido o tópico da validade do consentimento prestado, perante a ausência de informação clara por parte dos nubentes, e a forma como esta lacuna pode gerar anulabilidade ou até mesmo inexistência do negócio. Concluindo, pela necessidade de reformas legislativas, que venham a garantir transparência contratual, assegurando que existe uma consciência plena da parte dos nubentes antes de avançar com a celebração deste contrato.

This paper analyzes the growing obsolescence of the marriage contract, focusing on Portuguese law and highlighting its rigidity, lack of transparency, and incompatibilities with contemporary civil contract principles. The aim is to demonstrate that the parties to a marriage are often unaware of the legal effects of marriage, which leads to defects of consent, defects that ultimately contribute to increased litigation in the event of a breakdown. The research begins by tracing the historical evolution of the institution of marriage, where several defects of consent can be seen in the earliest manifestations of formal marriage. Next, a critique is made of its structure, which remains inflexible even after the various changes it has undergone over the years. Finally, the topic of the validity of consent given, in the absence of clear information on the part of the spouses, is discussed, as well as how this gap can lead to annulment or even the non-existence of the contract. In conclusion, there is a need for legislative reforms to ensure contractual transparency, guaranteeing that the parties are fully aware before proceeding with the celebration of this contract.
