Feminicídio: uma análise da responsabilidade internacional do estado brasileiro no combate à violência contra a mulher

Abstract

As mulheres têm direito a uma vida digna e livre de violência, garantido por meio de Convenções e normas – nacionais e internacionais –, cabendo ao Estado à garantia e a manutenção destes direitos. Indistintamente, há ainda o direito primordial à vida e de livre acesso à justiça e, quando um dos direitos básicos do cidadão é desrespeitado por atos dos agentes do Estado, cabe o dever de reparar o dano. Mister se faz no presente trabalho a necessidade de avaliar a violência sofrida por uma mulher, principalmente a cometida na esfera doméstica, o crescente número de feminicídios íntimos e a responsabilidade internacional do Estado brasileiro. Para a realização do trabalho foi utilizado o método qualitativo, buscando a obtenção de uma análise conceitual sobre a violência contra a mulher, o feminicídio, a existência e a eficácia de políticas públicas, e ainda, buscando uma análise sobre a responsabilidade do Estado brasileiro, inclusive perante a Corte Internacional de Direitos Humanos. Os resultados obtidos foram satisfatórios para a conclusão da pesquisa.

Women have the right to a life with dignity and free from violence, guaranteed by means of Conventions and norms - national and international - and the State is responsible for guaranteeing and maintaining these rights. Indistinctly, there is also the primordial right to life and to free access to justice and, when one of the basic rights of the citizen is disrespected by acts of State agents, it is the duty to repair the damage. It is necessary to evaluate the violence suffered by a woman, especially that committed in the domestic sphere, the growing number of intimate feminicides and the international responsibility of the Brazilian State. The qualitative method was used to carry out this study, seeking to obtain a conceptual analysis of violence against women, feminicide, the existence and effectiveness of public policies, and also to analyze the responsibility of the Brazilian State, including before the International Court of Human Rights. The results obtained were satisfactory for the conclusion of the research.
