Responsabilidade civil pela desistência da adoção

Abstract

Crianças e adolescentes têm o direito fundamental a viver e crescer no seio de uma família, mas diante de casos excepcionais onde não é possível à família de origem oferecer cuidado e proteção aos filhos, faz-se necessário assegurar o direito à convivência familiar por meio de colocação em família substituta, sendo uma das modalidades de se alcançar esse objetivo o instituto jurídico da adoção. Esse processo se realiza em etapas que avançam ao convívio até a consolidação da filiação por sentença, porém, em algumas hipóteses, fracassam dando ensejo a devolução do adotando ou mesmo o abandono. Este trabalho aborda a responsabilidade civil dos adotantes em caso de devolução da criança ou adolescente durante e após o processo de adoção, dando ensejo à possibilidade de responsabilizar civilmente pelos danos psíquicos causados pela rejeição, abalo, sofrimento e frustração decorrentes da devolução. A investigação é feita por uma revisão bibliográfica crítica fundamentada sob a ótica da proteção integral e do melhor interesse da criança. A pesquisa apresenta o instituto sob a perspectiva do direito de família e do direito de crianças e adolescentes e sugere reflexões nas diferentes etapas do processo de adoção relacionando com a questão da responsabilidade civil pela devolução da criança ou adolescente no curso do estágio de convivência, na guarda provisória para fins de adoção e após a sentença.

Children and adolescents have the fundamental right to live and grow up within a family, but in exceptional cases where it is not possible for the family of origin to provide care and protection for their children, it is necessary to ensure the right to family life through placement in a substitute family, one of the ways of achieving this objective being the legal institution of adoption. This process takes place in stages that progress towards cohabitation until the consolidation of filiation by sentence, but in some cases, they fail, giving rise to the return of the adoptee or even abandonment. This paper addresses the civil liability of adoptive parents in the event of the return of a child or adolescent during and after the adoption process, giving rise to the possibility of civil liability for the psychological damage caused by the rejection, shock, suffering, and frustration resulting from the return. The investigation is carried out through a critical literature review based on the perspective of comprehensive protection and the best interests of the child. The research presents the institute from the perspective of family law and the rights of children and adolescents and suggests reflections on the different stages of the adoption process in relation to the issue of civil liability for the return of the child or adolescent during the cohabitation stage, in temporary custody for adoption purposes and after the sentence.
